  1  1    Section 1.  NEW SECTION.  9E.9A  DEFECTIVE NOTARIAL ACT.
  1  2    An instrument in writing to which is attached a defective
  1  3 certificate of acknowledgment attached by a notary public more
  1  4 than ten years earlier is valid, legal, and binding as if the
  1  5 instrument had been properly acknowledged by the notary
  1  6 public.
  1  7    Sec. 2.  Section 586.1, subsections 1 and 2, Code 1995, are
  1  8 amended to read as follows:
  1  9    1.  Official acts performed before 1970 more than ten years
  1 10 earlier by notaries public during the time that they held over
  1 11 in office without qualifying after the expiration of the
  1 12 preceding term, if such notaries public have since
  1 13 subsequently qualified.
  1 14    2.  Acknowledgments taken before 1970 more than ten years
  1 15 earlier by notaries public outside their jurisdiction.  
  1 16                           EXPLANATION
  1 17           This bill provides that a defective notarial act
  1 18    completed more than 10 years earlier is valid, legal, and
  1 19  binding as if the instrument had been properly acknowledged.
