1 1 Section 1. Section 301.28, Code 1995, is amended by
1 2 striking the section and inserting in lieu thereof the
1 3 following:
1 4 301.28 OFFICERS AND TEACHERS AS AGENTS FOR BOOKS AND
1 5 SUPPLIES.
1 6 1. Except as provided in subsection 2, a school director,
1 7 officer, area education agency director, or teacher, who acts
1 8 as an agent or dealer in school textbooks or school supplies
1 9 for the district of office or employment, during the person's
1 10 term of office or employment, is guilty of a serious
1 11 misdemeanor.
1 12 2. A school director, officer, area education agency
1 13 director, or teacher may act as agent or dealer for school
1 14 textbooks or school supplies during the person's term of
1 15 office or employment if any of the following occurs:
1 16 a. Competitive bidding procedures are used and the
1 17 director, officer, or teacher is the lowest responsible bidder
1 18 whose products meet the specifications or description of the
1 19 product needed, or if the lowest responsible bid is made by an
1 20 out-of-state agent, and the director's, officer's, or
1 21 teacher's products meet the specifications or description of
1 22 the product needed and their bid is within ten percent of the
1 23 lowest reasonable bid made by the out-of-state agent.
1 24 b. The agent's sales to the district of office or
1 25 employment do not exceed one thousand dollars in any school
1 26 year.
1 27 c. The value of a contract for school textbooks or school
1 28 supplies, or the total value of all contracts with the
1 29 district of office or employment, is not more than ten percent
1 30 of the gross income, in a calendar year, of the business
1 31 represented or owned by the director, officer, or teacher.
1 32 EXPLANATION
1 33 This bill provides exceptions to the law prohibiting school
1 34 directors, officers, area education agency directors, and
1 35 teachers from acting as agents for school textbooks or school
2 1 supplies during their term of office or employment. The
2 2 exceptions are: (1) if competitive bidding procedures are
2 3 used and the director, officer, or teacher is the lowest
2 4 responsible bidder whose products meet the need described, or
2 5 if the lowest responsible bid is made by an out-of-state
2 6 agent, and the director, officer, or teacher's products meet
2 7 the need described and the bid is within 10 percent of the
2 8 lowest reasonable bid made by the out-of-state agent, (2) if
2 9 the agent's sales to the district of office or employment do
2 10 not exceed $1,000 in any school year, and (3) if the value of
2 11 a contract for school textbooks or supplies, or the total
2 12 value of all contracts with the district of office or
2 13 employment, is not more than 10 percent of the gross income,
2 14 in a calendar year, of the business represented or owned by
2 15 the director, officer, or teacher.
