1 1 Section 1. Section 135.11, Code 1995, is amended to add
1 2 the following new subsection:
1 3 NEW SUBSECTION. 25. Adopt rules which provide for the
1 4 expenditure of funds pursuant to section 453A.6, subsection
1 5 1A.
1 6 Sec. 2. Section 453A.6, Code 1995, is amended by adding
1 7 the following new subsection:
1 8 NEW SUBSECTION. 1A. In addition to the tax imposed
1 9 pursuant to subsection 1, there is imposed, and shall be
1 10 collected and paid to the department, the following tax on all
1 11 cigarettes used or otherwise disposed of in this state for any
1 12 purpose whatever, to be used as provided in this subsection:
1 13 CLASS A: On cigarettes weighing not more than three pounds
1 14 per thousand, seven mills on each such cigarette.
1 15 CLASS B: On cigarettes weighing more than three pounds per
1 16 thousand, seven mills on each such cigarette.
1 17 Revenues from the additional tax imposed under this
1 18 subsection shall be deposited in a separate fund in the state
1 19 treasury under the control of the department of public health.
1 20 The revenues in the separate fund are appropriated to the
1 21 department of public health, which, in consultation with the
1 22 governor's alliance on substance abuse, shall use the revenues
1 23 deposited in the fund to provide services to teenagers and
1 24 young adults to assist them in quitting smoking cigarettes,
1 25 and to pay for public service announcements, billboards, print
1 26 and broadcast media services, and other appropriate means to
1 27 discourage teenagers and young adults from starting to smoke
1 28 cigarettes.
1 29 EXPLANATION
1 30 This bill increases the tax imposed on cigarettes by 7
1 31 mills or 14 cents per pack of 20 cigarettes used or otherwise
1 32 disposed of in the state for any purpose. The bill provides
1 33 that the additional moneys collected will be used by the
1 34 department of public health, in consultation with the
1 35 governor's alliance on substance abuse, to assist teenagers
2 1 and young adults to quit smoking cigarettes and to fund public
2 2 service announcements to discourage teenagers and young adults
2 3 from beginning to smoke.
