PAG LIN 1 1 Section 1. Section 483A.24, subsection 2, Code 1995, is 1 2 amended to read as follows: 1 3 2. a. Upon written application, the department shall 1 4 issue without charge annually adeer orwild turkey hunting 1 5 license, or both,to the owner of a farm unit or a member of 1 6 the family of the farm owner and to the tenant or a member of 1 7 the family of the tenant. The license is valid for wild 1 8 turkey hunting on the farm unit only. 1 9 b. Upon written application, the department shall also 1 10 issue annually five deer hunting licenses to an owner of a 1 11 farm unit or to a member of the owner's family at the owner's 1 12 written request. If fewer than five deer licenses are 1 13 requested by an owner or if an owner releases a license, upon 1 14 written application, a tenant or a member of the tenant's 1 15 family of that farm unit shall be issued a deer license 1 16 without charge. Not more than five deer hunting licenses 1 17 shall be issued for each farm unit and the licenses shall be 1 18 valid for deer hunting on that farm unit only. More than one 1 19 deer license may be issued to the same owner or a member of 1 20 the owner's family. 1 21 Sec. 2. Section 483A.24, subsection 3, Code 1995, is 1 22 amended by striking the subsection and inserting in lieu 1 23 thereof the following: 1 24 3. To be eligible for a deer or wild turkey license 1 25 without charge pursuant to this section, an owner or a tenant 1 26 of a farm unit shall be a resident of this state and actively 1 27 engaged in the operation of the farm unit. A family member 1 28 shall reside with the owner or tenant of a farm unit. 1 29 Sec. 3. Section 483A.24, subsection 4, Code 1995, is 1 30 amended by striking the subsection. 1 31 Sec. 4. Section 483A.24, subsection 7, Code 1995, is 1 32 amended to read as follows: 1 33 7. As used in this section a "farm unit" is all the 1 34 parcels of land, not necessarily contiguous, which are 1 35 operated as a unit for agricultural purposes and which are 2 1 under the lawful control of the landowner or tenant, and a2 2"tenant" is a person, other than the landowner, who resides on2 3the farm unit and is actively engaged in the operation of the2 4farm unit. 2 5 EXPLANATION 2 6 This bill provides that the department of natural resources 2 7 shall issue without charge five free deer hunting licenses to 2 8 the owner of a farm unit or a member of the owner's family 2 9 residing with the owner at the owner's request. More than one 2 10 deer license may be issued to the same owner or member of the 2 11 owner's family. If the owner or the owner's family does not 2 12 request all five licenses or if the owner releases one of the 2 13 deer licenses, the tenant or a member of the tenant's family 2 14 shall be issued one of the deer licenses without charge. 2 15 The owner or tenant of a farm unit must be a resident in 2 16 this state and be actively engaged in operation of the farm 2 17 unit to be eligible for the wild turkey and deer licenses 2 18 without charge. 2 19 LSB 3335HH 76 2 20 tj/jj/8
