PAG LIN 1 1 Section 1. Section 321.189, subsection 7, paragraphs a and 1 2 b, Code 1995, are amended to read as follows: 1 3 a. An operator who has been issued a class M license prior 1 4 to July 1,19941996, or the effective date of the motorcycle 1 5 education course requirements whichever is later. 1 6 b. An operator who is renewing the operator's class M 1 7 license issued prior to July 1,19941996, or the effective 1 8 date of the motorcycle education course requirements whichever 1 9 is later. 1 10 Sec. 2. Section 321.189, subsection 7, Code 1995, is 1 11 amended by adding the following new unnumbered paragraph: 1 12 NEW UNNUMBERED PARAGRAPH. The motorcycle rider education 1 13 requirements for persons aged eighteen and over in this 1 14 subsection take effect July 1, 1996, or at such time as the 1 15 department of education adopts rules and has adequate training 1 16 vehicles, instructors, curriculum materials, training sites, 1 17 and funding to implement the motorcycle rider education 1 18 requirements for persons aged eighteen and over in this 1 19 subsection. 1 20 Sec. 3. 1994 Iowa Acts, chapter 1102, section 4, as 1 21 amended by 1994 Iowa Acts, chapter 1199, section 52, is 1 22 amended to read as follows: 1 23 SEC. 4. EFFECTIVE DATE. The provisions of this Act which 1 24 amend section 321.189,take effectMay 1, 1995July 1, 1996, 1 25 or at such time as the department of education adopts rules 1 26 and has adequate training vehicles, instructors, curriculum 1 27 materials, training sites, and funding to implement the 1 28 motorcycle rider education requirements. 1 29 Sec. 4. The department of education shall notify the 1 30 secretary of state and the Iowa Code editor of the effective 1 31 date of this Act. 1 32 Sec. 5. EFFECTIVE DATE AND APPLICABILITY. This Act, being 1 33 deemed of immediate importance, takes effect upon enactment 1 34 and applies retroactively to May 1, 1995, in order to delay 1 35 the effective date of the amendments to section 321.189, 2 1 subsection 7, Code 1993. 2 2 EXPLANATION 2 3 During the 1994 legislative session, section 321.189, 2 4 subsection 7, was amended to require that all persons applying 2 5 for a driver's license valid for operation of a motorcycle 2 6 must take a motorcycle education course before the license 2 7 would be issued. Prior to the amendment, and still the law as 2 8 stated in section 321.189, Code 1993, only persons under the 2 9 age of 18 were and are required to complete a motorcycle 2 10 education course before the class M license is issued. The 2 11 effective date of the amendment to section 321.189, subsection 2 12 7, is May 1, 1995. This bill changes the effective date of 2 13 the amendments from May 1, 1995, to July 1, 1996, or at such 2 14 time as the department of education adopts rules and has 2 15 adequate training vehicles, instructors, curriculum materials, 2 16 training sites, and funding to implement motorcycle rider 2 17 education requirements. The bill also changes the persons who 2 18 are excepted from the requirements to those who had class M 2 19 licenses prior to the new effective date of the changes. 2 20 LSB 1868HV 76 2 21 js/jw/5
