1 1 Section 1. Section 280.17, Code 1995, is amended by adding
1 2 the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. The guidelines of the model
1 4 policy in rules adopted by the department of education under
1 5 this section shall prohibit the board of directors of a public
1 6 school or the authorities in control of a nonpublic school
1 7 from designating an employee of the school district or
1 8 nonpublic school to perform any level of investigation under
1 9 this section.
1 10 EXPLANATION
1 11 This bill relates to school procedures for handling child
1 12 abuse reports alleged to have been committed by an employee or
1 13 agent of a public or nonpublic school. Under current law,
1 14 section 280.17 requires a board of directors of a public
1 15 school and the authorities in control of a nonpublic school to
1 16 prescribe procedures for the handling of child abuse reports
1 17 alleged to have been committed by an employee of the public
1 18 school or nonpublic school. The procedures are to be adopted
1 19 in accordance with guidelines in a model policy adopted by the
1 20 department of education in consultation with the department of
1 21 human services. The bill specifically prohibits a board of
1 22 directors of a public school or nonpublic school from
1 23 designating an employee to perform an investigation.
