  1  1    Section 1.  Section 543B.27, Code 1995, is amended to read
  1  2 as follows:
  1  3    543B.27  FEES.
  1  4    1.  The real estate commission shall set fees, for
  1  5 examination and licensing of real estate brokers and real
  1  6 estate salespersons.  The commission shall determine the
  1  7 annual cost of administering the examination and shall set the
  1  8 examination fee accordingly.  The commission shall set the
  1  9 fees for the real estate broker's licenses and for real estate
  1 10 salesperson's licenses based upon the administrative costs of
  1 11 sustaining the commission.  The fees shall include, but shall
  1 12 not be limited to, the costs for:
  1 13    1. a.  Per diem, expenses, and travel for commission
  1 14 members.
  1 15    2. b.  Office facilities, supplies, and equipment.
  1 16    3. c.  Staff assistance.
  1 17    4. d.  Establishing and maintaining a real estate education
  1 18 program.
  1 19    2.  Notwithstanding subsection 1, a nonresident person
  1 20 seeking to procure a license pursuant to this chapter shall be
  1 21 charged a fee equal to the greater of the following:
  1 22    a.  The fee as determined pursuant to subsection 1.
  1 23    b.  A fee equal to the fee the nonresident person would be
  1 24 charged by such person's state of residence if that person
  1 25 were a resident of this state making application for a license
  1 26 in that state.  
  1 27                           EXPLANATION
  1 28    This bill provides that a nonresident person making
  1 29 application to be licensed as a real estate broker or
  1 30 salesperson in this state is to be charged a fee which equals
  1 31 the greater of the fee which would be charged a resident of
  1 32 this state, or a fee equal to the fee a resident of this state
  1 33 pays in the nonresident person's state to be licensed.
