1 1 Section 1. Section 72.1, Code 1995, is amended to read as
1 2 follows:
1 3 72.1 CONTRACTS FOR EXCESS EXPENDITURES &endash; EXCEPTION FOR
1 4 COAL.
1 5 Officers empowered to expend, or direct the expenditure of,
1 6 public money of the state shall not make any contract for any
1 7 purpose which contemplates an expenditure of such money in
1 8 excess of one million dollars unless competitive bidding
1 9 procedures as provided by section 18.6 and the rules adopted
1 10 pursuant to that section are followed, or in excess of that
1 11 authorized by law. However, the state or an agency of the
1 12 state may enter into a contract of not exceeding ten years in
1 13 duration for the purchase of coal to be used in facilities
1 14 under the jurisdiction of the state or the state agency. The
1 15 execution of the contract shall be contingent upon
1 16 appropriations by the general assembly in sufficient amounts
1 17 to meet the terms of the contract.
1 18 EXPLANATION
1 19 This bill provides that a contract involving the
1 20 expenditure of state moneys in excess of $1 million must
1 21 follow competitive bidding procedures as provided by section
1 22 18.6 and the rules adopted pursuant to that section.
