PAG LIN 1 1 Section 1. Section 331.321, subsection 1, paragraph n, 1 2 Code 1995, is amended by striking the paragraph. 1 3 Sec. 2. Section 331.322, subsections 6 and 7, Code 1995, 1 4 are amended by striking the subsections. 1 5 Sec. 3. Section 331.907, subsections 1 and 2, Code 1995, 1 6 are amended to read as follows: 1 7 1. The annual compensation of the auditor, treasurer, 1 8 recorder, sheriff, county attorney, and supervisors shall be 1 9 determined as provided in this section. Thecounty compen-1 10sationboard annually shall review the compensation paid to 1 11 comparable officers in other counties of this state, other 1 12 states, private enterprise, and the federal government. If an 1 13 elected county officer has received increased duties due to 1 14 reorganization or consolidation of offices, or another 1 15 mandate, the board shall appoint a committee of supervisors, 1 16 other county officers, and the public to recommend an initial 1 17 annual salary for that officer. In setting the salary of the 1 18 county sheriff, thecounty compensationboard shall consider 1 19 setting the sheriff's salary so that it is comparable to 1 20 salaries paid to professional law enforcement administrators 1 21 and command officers of the Iowa highway safety patrol, the 1 22 division of criminal investigation of the department of public 1 23 safety, and city police agencies in this state. Thecounty1 24compensationboard shall prepare a compensation schedule for 1 25 the elective county officers for the succeeding fiscal year. 1 26 Any change in the compensation schedule, except for the 1 27 committee's recommendation, shall be an equal percentage for 1 28 each elected officer. A recommended compensation schedule 1 29 requires a majority vote of the membership of thecounty1 30compensationboard. 1 31 2. At the public hearing held on the county budget as 1 32 provided in section 331.434, thecounty compensationboard 1 33 shall submit its recommended compensation schedule for the 1 34 next fiscal yearto the board of supervisorsfor inclusion in 1 35 the county budget.TheAfter the hearing, the boardof2 1supervisorsshallreview the recommended compensation schedule2 2for the elected county officers anddetermine the final 2 3 compensation schedulewhich shall not exceed the compensation2 4schedule recommended by the county compensation board. In 2 5 determining the final compensation schedule if the boardof2 6supervisorswishes toreducechange theamount of the2 7 recommended compensation schedule, the amount of salary 2 8 increase proposed for each elected county officer shall be 2 9reducedchanged an equal percentage. A copy of the final 2 10 compensation schedule shall be filed with the county budget at 2 11 the office of the director of the department of management. 2 12 The final compensation schedule takes effect on July 1 2 13 following its adoption by the board of supervisors. 2 14 Sec. 4. REPEALER. Section 331.905, Code 1995, is 2 15 repealed. 2 16 EXPLANATION 2 17 This bill provides that the annual salaries of the elected 2 18 county officers shall be determined by the board of 2 19 supervisors. However, each annual salary shall be adjusted by 2 20 the same percentage. If the duties of an elected county 2 21 officer are increased by reorganization or consolidation of 2 22 county offices, the board of supervisors shall appoint a 2 23 committee of supervisors, other elected officers, and the 2 24 general public to recommend an initial salary for that 2 25 officer. 2 26 LSB 2158HH 76 2 27 tj/jw/5
