  1  1    Section 1.  Section 85.1, subsection 1, Code 1995, is
  1  2 amended to read as follows:
  1  3    1.  Any employee engaged in any type of service in or about
  1  4 a private dwelling except that after July 1, 1974, this
  1  5 chapter shall apply to such persons who earn two seven hundred
  1  6 fifty dollars or more from such employer for whom employed at
  1  7 the time of the injury during the thirteen consecutive weeks
  1  8 prior to the injury, provided said the employee is not a
  1  9 regular member of the household.  For purposes of this
  1 10 subsection "member of the household" is defined to be the
  1 11 spouse of the employer or relatives of either the employer or
  1 12 spouse residing on the premises of the employer.
  1 13    Sec. 2.  Section 85.1, subsection 2, Code 1995, is amended
  1 14 to read as follows:
  1 15    2.  Persons whose employment is purely casual and not for
  1 16 the purpose of the employer's trade or business, except that
  1 17 after July 1, 1974, this chapter shall apply to such employees
  1 18 who earn two seven hundred fifty dollars or more from such
  1 19 employer for whom employed at the time of the injury during
  1 20 the thirteen consecutive weeks prior to the injury.  
  1 21                           EXPLANATION
  1 22    This bill provides that a person engaged in casual
  1 23 employment or in service in or about a private dwelling is not
  1 24 covered by workers' compensation if they earn less than $750
  1 25 during the 13 weeks prior to the injury.  Current law provides
  1 26 that workers' compensation does not apply if the person earns
  1 27 less than $200 during the 13 weeks.  An employer is still able
  1 28 to assume workers' compensation liability for these persons
  1 29 but only if the employer purchases workers' compensation
  1 30 insurance.
