1 1 Section 1. Section 572.32, Code 1995, is amended by
1 2 striking the section and inserting in lieu thereof the
1 3 following:
1 4 572.32 ATTORNEY FEES.
1 5 In a court action to enforce a mechanic's lien the
1 6 prevailing party shall be awarded reasonable attorney fees.
1 7 EXPLANATION
1 8 This bill provides that in a court action to enforce a
1 9 mechanic's lien the successful party shall be awarded
1 10 reasonable attorney fees. Currently, a plaintiff in such
1 11 action who furnishes labor or material directly to the
1 12 defendant and is successful is to be awarded reasonable
1 13 attorney fees.
