1 1 Section 1. Section 8D.13, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 5A. Notwithstanding subsection 5, the
1 4 state may own fiber optic cable facilities or facilities with
1 5 DS-3 capacity for a part III connection which is a spur
1 6 connection. For purposes of this subsection, "spur
1 7 connection" means a connection which is associated with a part
1 8 III authorized user which is a school district, an accredited
1 9 nonpublic school, an area education agency, a city library, a
1 10 regional library as provided in chapter 256, or a county
1 11 library as provided in chapter 336 and which is located no
1 12 more than one and one-half miles from a fiber optic cable
1 13 route used or to be used for connecting an Iowa national guard
1 14 facility to the network, or no more than one and one-half
1 15 miles from an Iowa national guard facility which is or is to
1 16 be connected to the network. The spur connection shall be for
1 17 a single site within the school district, accredited nonpublic
1 18 school, area education agency office, city library, regional
1 19 library, and county library as determined by the local school
1 20 board, accredited nonpublic school, area education agency
1 21 board, or governing entity of such library, as applicable, and
1 22 approved by the commission. The spur connection shall be no
1 23 more than one and one-half miles long and shall be connected
1 24 to such fiber optic cable route or national guard facility.
1 25 EXPLANATION
1 26 This bill provides that the state may own fiber optic cable
1 27 facilities or facilities with DS-3 capacity for a connection
1 28 associated with a part III authorized user which is a school
1 29 district, an accredited nonpublic school, an area education
1 30 agency, a city library, a regional library, or a county
1 31 library and which is located no more than one and one-half
1 32 miles from a fiber optic cable route used or to be used for
1 33 connecting an Iowa national guard facility to the network, or
1 34 no more than one and one-half miles from an Iowa national
1 35 guard facility which is or is to be connected to the network.
2 1 These connections are defined as spur connections.
