PAG LIN 1 1 Section 1. Section 294A.3, unnumbered paragraph 1, Code 1 2 1995, is amended to read as follows: 1 3 An educational excellence fund is established in the office 1 4 of treasurer of state to be administered by the department of 1 5 education. Moneys appropriated by the general assembly for 1 6 deposit in the fund shall be paid to school districts and area 1 7 education agencies pursuant to the requirements of this 1 8 chapter and shall be expended only to pay for increases in the 1 9 regular compensation of teachers and other salary increases 1 10 for teachers, to pay the costs of the employer's share of 1 11 federal social security and Iowa public employees' retirement 1 12 system, or a pension and annuity retirement system established 1 13 under chapter 294, payments on the salary increases, and to 1 14 pay costs associated with providing computer equipment or 1 15 specialized or general training. Moneys received by school 1 16 districts and area education agencies shall not be used for 1 17 pay earned by a teacher for performance of additional 1 18 noninstructional duties. 1 19 Sec. 2. Section 294A.13, Code 1995, is amended to read as 1 20 follows: 1 21 294A.13 PHASE III PROGRAM. 1 22 For the school year beginning July 1, 1987, and succeeding 1 23 school years, each school district and area education agency 1 24 that meets the requirements of thissectiondivision is 1 25 eligible to receive moneys for the implementation under phase 1 26 III of a performance-based pay plan or supplemental pay plan, 1 27 or a combination of the two. 1 28 Sec. 3. Section 294A.14, unnumbered paragraphs 3 and 4, 1 29 Code 1995, are amended to read as follows: 1 30 A plan shall be developed using the procedure specified 1 31 under section 294A.15. The plan shall provide for the 1 32 establishment of a performance-based pay plan, a supplemental 1 33 pay plan, a combination of the two pay plans, or comprehensive 1 34 school transformation programs, and shall include a budget for 1 35 the cost of implementing the plan. In addition to the costs 2 1 of providing additional salary for teachers and the amount 2 2 required to pay the employers' share of the federal social 2 3 security and Iowa public employees' retirement system, or a 2 4 pension and annuity retirement system established under 2 5 chapter 294, and payments on the additional salary, the budget 2 6 may include costs associated with providing computer equipment 2 7 or specialized or general training. Moneys received under 2 8 phase III shall not be used to employ additional employees of 2 9 a school district, except that phase III moneys may be used to 2 10 employ substitute teachers, part-time teachers, and other 2 11 employees needed to implement plans that provide innovative 2 12 staffing patterns or that require that a teacher employed on a 2 13 full-time basis be absent from the classroom for specified 2 14 periods for fulfilling other instructional duties. However, 2 15 all teachers employed are eligible to receive additional 2 16 salary under an approved plan. 2 17 For the purpose of this section, a performance-based pay 2 18 plan shall provide for salary increases for teachers who 2 19 demonstrate superior performance in completing assigned 2 20 duties. In lieu of or in addition to salary increases 2 21 provided under this section, a performance-based pay plan may 2 22 provide, under an agreement with the teacher, computer 2 23 equipment to teachers who demonstrate superior performance in 2 24 completing assigned duties. The value of computer equipment 2 25 provided in lieu of or in addition to salary increases under 2 26 this section shall be the current fair and reasonable market 2 27 value of the equipment when ownership of the equipment is 2 28 transferred to the teacher. The plan shall include the method 2 29 used to determine superior performance of a teacher. For 2 30 school districts, the plan may include assessments of specific 2 31 teaching behavior, assessments of student performance, 2 32 assessments of other characteristics associated with effective 2 33 teaching, or a combination of these criteria. 2 34 EXPLANATION 2 35 This bill provides that a school district may provide, as 3 1 part of its performance-based pay plan under phase III of the 3 2 educational excellence program, computer equipment to teachers 3 3 who demonstrate superior performance in completing assigned 3 4 duties. Under an agreement with the teacher, the district 3 5 would provide the computer equipment in lieu of or in addition 3 6 to a salary increase under phase III. The bill requires that 3 7 the value of computer equipment be the current fair and 3 8 reasonable market value of the equipment when ownership of the 3 9 equipment is transferred to the teacher. 3 10 The bill also amends section 294A.13, which states that 3 11 each school district and area education agency that meets the 3 12 requirements of the section is eligible for phase III funds. 3 13 However, the requirements are set forth in the division, and 3 14 not in the section.
