PAG LIN 1 1 Section 1. Section 80A.7, Code 1995, is amended to read as 1 2 follows: 1 3 80A.7 IDENTIFICATION CARDS. 1 4 The department shall issue to each licensee and to each 1 5 employee of the licensee an identification card in a form 1 6 approved by the commissioner. The application for a permanent 1 7 identification card shall include a temporary identification 1 8 card valid for fourteen days from the date of receipt of the 1 9 application by the applicant. It is unlawful for an agency 1 10 licensed under this chapter to employ a person to act in the 1 11 private investigation business or private security business 1 12 unless the person has in the person's immediate possession an 1 13 identification card issued under this section. 1 14 The licensee is responsible for the use of identification 1 15 cards by the licensee's employees and shall return an 1 16 employee's card to the department upon termination of the 1 17 employee's service. Identification cards remain the property 1 18 of the department. The fee for each card is ten dollars. 1 19 The department may issue identification cards to 1 20 individuals fulfilling the requirements for a private security 1 21 guard, private investigator, a certified security officer, an 1 22 armed security officer, an armed private investigator, and an 1 23 armored car guard. 1 24 A private security guard and a private investigator may be 1 25 issued identification cards upon fulfillment of the 1 26 requirements of section 80A.4, subsection 1. 1 27 A certified security officer must complete departmental 1 28 requirements to be licensed as a security guard and also 1 29 successfully complete a certified security officer training 1 30 course as defined by the department. A certified security 1 31 officer shall not use firearms, but may use defensive weapons 1 32 and restraining devices in the line of duty, but only upon 1 33 completion of a course approved by the department in the use 1 34 of these weapons. 1 35 An armed security officer must be currently certified in 2 1 this state as a certified security officer and must have 2 2 successfully completed a firearms training program and have 2 3 qualified to a standard approved by the department which is 2 4 equivalent to the firearms training and standards of a peace 2 5 officer. 2 6 An armed private investigator must be currently licensed as 2 7 a private investigator and must have successfully completed a 2 8 firearms training program and have qualified to a standard 2 9 approved by the department which is equivalent to the firearms 2 10 training and standards of a peace officer. An armed private 2 11 investigator may use defensive weapons and restraining devices 2 12 in the line of duty, but only after completion of a course 2 13 approved by the department in the use of these weapons. 2 14 An armored car guard must complete departmental 2 15 requirements to be licensed as a security guard and must have 2 16 successfully completed a firearms training program and have 2 17 qualified to a standard approved by the department which is 2 18 equivalent to the firearms training and standards of a peace 2 19 officer. 2 20 A county sheriff may issue temporary identification cards 2 21 valid for fourteen days to a person employed by an agency 2 22 licensed as a private security business or private 2 23 investigation business on a temporary basis in the county. 2 24 The fee for each card is five dollars. The form of the 2 25 temporary identification cards shall be approved by the 2 26 commissioner. 2 27 Sec. 2. Section 80A.18, Code 1995, is amended to read as 2 28 follows: 2 29 80A.18 RECIPROCITY &endash; FEE. 2 30 A person who holds a valid license to act as a private 2 31 investigator,or as aprivate securityofficerguard, 2 32 certified security officer, armed security officer, armed 2 33 private investigator, or armored car guard issued by a proper 2 34 authority of another state, based on requirements and 2 35 qualifications similar to the requirements of this chapter, 3 1 may be issued a temporary permit to so act in this state, if 3 2 the person's licensing jurisdiction extends by reciprocity 3 3 similar privileges to a person licensed to act as a private 3 4 investigator or private security officer licensed by this 3 5 state. Any reciprocal agreement approved by the commissioner 3 6 shall provide that any misconduct in the state issuing the 3 7 temporary permit will be dealt with in the licensing 3 8 jurisdiction as though the violation occurred in that 3 9 jurisdiction. 3 10 The commissioner shall adopt by rule a fee for the issuance 3 11 of a temporary permit under this section. The fee shall be 3 12 based on the cost of administering this section but shall not 3 13 exceed one hundred dollars per year. 3 14 EXPLANATION 3 15 This bill provides for four additional categories of 3 16 licensees in the areas of private investigators and security 3 17 guards. The four new categories are certified security 3 18 officer, armed security officer, armed private investigator, 3 19 and armored car guard. The requirements for each category are 3 20 set out in the bill. Reciprocity language is expanded to 3 21 include the four new categories. 3 22 LSB 1826HH 76 3 23 cl/cf/24.1
