1 1 Section 1. Section 307.12, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 16. Establish accident prevention courses
1 4 for persons aged fifty-five or older as required by section
1 5 516B.4.
1 6 Sec. 2. NEW SECTION. 516B.4 REDUCTION IN RATES FOR
1 7 INSUREDS AGED FIFTY-FIVE OR OLDER WHO COMPLETE AN ACCIDENT
1 8 PREVENTION COURSE.
1 9 1. The commissioner shall require that insurance companies
1 10 transacting business in this state provide an appropriate
1 11 reduction in premiums for automobile liability insurance for
1 12 insureds aged fifty-five or older who every three years
1 13 successfully complete an accident prevention course
1 14 established pursuant to this section.
1 15 2. The state department of transportation shall, by
1 16 January 1, 1996, establish a motor vehicle accident prevention
1 17 course for persons aged fifty-five or older. The department
1 18 in establishing the course shall, at a minimum, do all of the
1 19 following:
1 20 a. Establish curriculum requirements.
1 21 b. Establish the number of hours required for successful
1 22 completion of the course.
1 23 c. Provide for the issuance of a course completion
1 24 certificate and requiring its submission to an insurer as
1 25 evidence of completion of the course.
1 26 d. Require persons aged fifty-five or older to retake the
1 27 course every three years to remain eligible for a premium
1 28 reduction.
1 29 3. This section shall not apply to any motor vehicle which
1 30 is a part of a fleet or is used for commercial purposes unless
1 31 there is a regularly assigned principal driver and shall not
1 32 apply to any policy of group automobile insurance under which
1 33 premiums are broadly averaged for the group rather than
1 34 determined individually.
1 35 Sec. 3. This Act takes effect on January 1, 1996.
2 1 EXPLANATION
2 2 This bill provides for a premium reduction for insureds
2 3 aged 55 or older who complete an accident reduction course.
2 4 The director of transportation is required to establish the
2 5 course by January 1, 1996, by establishing certain curriculum
2 6 and hour requirements, and providing for issuance of a
2 7 certificate upon completion. The bill provides that an
2 8 insured must retake the course every three years in order to
2 9 remain eligible for the premium reduction. The effective date
2 10 of the bill is January 1, 1996.
