PAG LIN 1 1 Section 1. Section 321.34, subsection 7, Code 1995, is 1 2 amended to read as follows: 1 3 7. HANDICAPPED PLATES. The owner of a motor vehicle 1 4 subject to registration pursuant to section 321.109, 1 5 subsection 1, light delivery truck, panel delivery truck, or 1 6 pickup, who is a handicapped person, or who is the parent or 1 7 guardian of a child who resides with the parent or guardian 1 8 owner and who is a handicapped person, as defined in section 1 9 321L.1, may, upon written application to the department, order 1 10 handicapped registration plates designed by the department 1 11 bearing the international symbol of accessibility. The 1 12 handicapped registration plates shall only be issued if the 1 13 application is accompanied with a statement from a physician 1 14 licensed under chapter 148, 149, 150, or 150A, or a 1 15 chiropractor licensed under chapter 151, written on the 1 16 physician's or chiropractor's stationery, stating the nature 1 17 of the applicant's or the applicant's child's handicap and 1 18 such additional information as required by rules adopted by 1 19 the department, including proof of residency of a child who is 1 20 a handicapped person. If the application is approved by the 1 21 department the handicapped registration plates shall be issued 1 22 to the applicant in exchange for the previous registration 1 23 plates issued to the person. The fee for the handicapped 1 24 plates is five dollars which is in addition to the regular 1 25 annual registration fee. The department shall validate the 1 26 handicapped plates in the same manner as regular registration 1 27 plates are validated under this section at the regular annual 1 28 registration fee. However, the handicapped plates shall not 1 29 be renewed without the applicant furnishing evidence to the 1 30 department in accordance with section 321L.2, that the owner 1 31 of the motor vehicle or the owner's child is still a 1 32 handicapped person as defined in section 321L.1, unless the1 33applicant has previously provided satisfactory evidence to the1 34department that the owner of the vehicle or the owner's child1 35is permanently handicapped in which case the furnishing of2 1additional evidence shall not be required for renewal. 2 2However, anAn owner who has a child who is a handicapped 2 3 person shall provide satisfactory evidence to the department 2 4 that the handicapped child continues to reside with the owner. 2 5 The handicapped registration plates shall be surrendered in 2 6 exchange for regular registration plates when the owner of the 2 7 motor vehicle or the owner's child no longer qualifies as a 2 8 handicapped person as defined in section 321L.1 or when the 2 9 owner's child who is a handicapped person no longer resides 2 10 with the owner. 2 11 Sec. 2. Section 321L.2, subsection 1, paragraph a, Code 2 12 1995, is amended to read as follows: 2 13 a. A handicapped resident of the state desiring a 2 14 handicapped identification device shall apply to the 2 15 department upon an application form furnished by the 2 16 department providing the applicant's name, address, date of 2 17 birth, and social security number and shall also provide a 2 18 statement from a physician licensed under chapter 148, 149, 2 19 150, or 150A, or a chiropractor licensed under chapter 151, or 2 20 a physician or chiropractor licensed to practice in a 2 21 contiguous state, written on the physician's or chiropractor's 2 22 stationery, stating the nature of the applicant's handicap and 2 23 such additional information as required by rules adopted by 2 24 the department under section 321L.8. Handicapped registration 2 25 plates must be ordered pursuant to section 321.34, subsection 2 26 7. A handicapped person may apply for either one temporary or 2 27 one permanent handicapped identification hanging device. 2 28 Persons who seek a permanent handicapped identification device 2 29 shall be required to furnish evidence upon initial application 2 30 that they are permanently handicapped and furnish evidence at 2 31 one-year intervals that they remain permanently handicapped. 2 32A person who has provided satisfactory evidence to the2 33department that the person is permanently handicapped shall2 34not be required to furnish evidence of being handicapped at a2 35later date, unless the department deems it necessary.Persons 3 1 who seekonlytemporary handicapped identification stickers or 3 2 hanging devices shall be required to furnish evidence upon 3 3 initial application that they are temporarily handicapped and,3 4in addition,furnish evidence at three-month intervals that 3 5 they remain temporarily handicapped. Temporary handicapped 3 6 identification stickers and hanging devices shall be of a 3 7 distinctively different color from permanent handicapped 3 8 identification stickers and hanging devices. 3 9 Sec. 3. Section 321L.2, subsection 3, unnumbered paragraph 3 10 1, Code 1995, is amended to read as follows: 3 11 Each handicapped identification device shall be acquired by 3 12 the department and sold at a cost not to exceed five dollars, 3 13 to handicapped persons upon application on forms prescribed by 3 14 the department. Before delivering a handicapped 3 15 identification device to a handicapped person the department 3 16 shall permanently affix to the device a unique number which 3 17 may be used by the department to identify the individual to 3 18 whom the device is issued. Atemporaryhandicapped 3 19 identification hanging device shall have the expiration date 3 20 permanently affixed to the device. Expiration dates and 3 21 identification numbers affixed to handicapped identification 3 22 hanging devices shall be of sufficient size to be readable 3 23 from outside the vehicle. 3 24 EXPLANATION 3 25 This bill requires a person who has been issued a permanent 3 26 handicapped identification device, or the owner of a motor 3 27 vehicle who is a handicapped person, or the parent or guardian 3 28 of a handicapped child who has been issued a handicapped 3 29 registration plate, to renew the device or registration plate 3 30 on an annual basis by furnishing evidence that the person or 3 31 the child is still handicapped. Current law does not require 3 32 a handicapped person who has been issued a permament 3 33 handicapped identification device, or the owner of a motor 3 34 vehicle who has been issued a permanent handicapped 3 35 registration plate, to furnish any further evidence that the 4 1 person or the child is still handicapped. 4 2 LSB 1119YH 76 4 3 js/cf/24
