1 1 Section 1. NEW SECTION. 70A.40 STATE COMPUTER USE &endash;
1 2 NONOFFICIAL PROGRAMS PROHIBITED.
1 3 1. As used in this section, unless the context otherwise
1 4 requires:
1 5 a. "Computer" means a programmable electronic device which
1 6 performs logical, arithmetical, and memory functions by
1 7 manipulations of electronic or magnetic impulses, and which is
1 8 used for performing operations involving the high speed
1 9 processing of data, including any input, output, processing,
1 10 storage, software, storage medium, display communication,
1 11 scanning, or printing facilities connected or related to the
1 12 device.
1 13 b. "Program" means ordered instructions or statements,
1 14 languages, or procedures that are read and operated as
1 15 electronic or magnetic impulses by and accessed from a
1 16 computer for purposes of performing operations involving the
1 17 high speed processing of data.
1 18 2. A person who is a state officer or employee shall not
1 19 install or store a program on a computer owned or operated by
1 20 a state agency in any branch of state government, or operate
1 21 such a computer in order to access a program, if the program
1 22 is unrelated to the duties or employment of the person or to
1 23 other state officers or employees, including but not limited
1 24 to programs designed solely for purposes of entertainment,
1 25 competition, or amusement.
1 26 EXPLANATION
1 27 This bill prohibits a person who is a state officer or
1 28 employee from installing or storing a program on a state
1 29 computer, or operating a state computer in order to access a
1 30 program, if the program is unrelated to the duties or
1 31 employment of the person or other state officers or employees,
1 32 including but not limited to programs designed solely for
1 33 purposes of entertainment, competition, or amusement.
