PAG LIN 1 1 Section 1. Section 321.324A, subsection 2, Code 1995, is 1 2 amended to read as follows: 1 3 2. Upon the immediate approach of a funeral procession, 1 4 the driver of every other vehicle, except an authorized 1 5 emergency vehicle, shall yield the right-of-way.AnIf the 1 6 procession is in compliance with this section or if the 1 7 procession is in compliance with the laws governing funeral 1 8 processions in a state through which the procession will 1 9 travel and the local authorities in this state have been given 1 10 notice, an operator of a motor vehicle which is part of a 1 11 funeral procession shall not be charged with violating traffic 1 12 rules and regulations relating to traffic signals and devices 1 13 while participating in the procession, unless the operation 1 14 is reckless. 1 15 EXPLANATION 1 16 This bill provides that a motor vehicle in a funeral 1 17 procession, including the lead vehicle, shall not be charged 1 18 with violating traffic rules if the vehicle complies with the 1 19 laws of a state the procession travels through, so long as the 1 20 local authorities in this state are notified. Current law 1 21 exempts vehicles from the traffic rules only if the procession 1 22 complies with the laws of this state governing funeral 1 23 processions as provided for in section 321.324A. 1 24 LSB 1458HH 76 1 25 ec/jw/5
