1 1 Section 1. Section 515D.4, subsection 5, Code 1995, is
1 2 amended to read as follows:
1 3 5. The named insured or any operator who either resides in
1 4 the same household or customarily operates an automobile
1 5 insured under the policy has that person's driver's license
1 6 suspended or revoked during the policy term or, if the policy
1 7 is a renewal, during its term or the one hundred eighty days
1 8 immediately preceding its effective date. Notice of
1 9 cancellation, for reasons stated in this subsection, shall
1 10 include a copy of the driving record of the person whose
1 11 driver's license was suspended or revoked.
1 12 Sec. 2. Section 515D.7, Code 1995, is amended by adding
1 13 the following new unnumbered paragraph after unnumbered
1 14 paragraph 2:
1 15 NEW UNNUMBERED PARAGRAPH. If intent not to renew is based
1 16 upon revocation or suspension of the insured's driver's
1 17 license, notice under this section shall include a copy of the
1 18 insured's driving record.
1 19 Sec. 3. Section 516B.3, Code 1995, is amended by adding
1 20 the following new subsection:
1 21 NEW SUBSECTION. 3. If an insurer refuses to issue a
1 22 policy based upon the driving record of the person seeking
1 23 automobile liability insurance, the insurer shall include in
1 24 the letter of denial a copy of the person's driving record
1 25 upon which the denial is based.
1 26 EXPLANATION
1 27 This bill requires that an insurer shall provide a copy of
1 28 a person's driving record if the person who is applying for
1 29 automobile insurance is denied coverage based upon the
1 30 person's driving record or an insured's coverage is either
1 31 cancelled or not renewed based upon the insured's driving
1 32 record.
