1 1 Section 1. Section 260C.14, subsection 2, Code 1995, is
1 2 amended to read as follows:
1 3 2. Have authority to determine tuition rates for
1 4 instruction. Tuition for residents of Iowa shall not exceed
1 5 the lowest tuition rate per semester, or the equivalent,
1 6 charged by an institution of higher education under the state
1 7 board of regents for a full-time resident student. However,
1 8 except for students enrolled under chapter 261C, if a local
1 9 school district pays tuition for a resident pupil of high
1 10 school age, the limitation on tuition for residents of Iowa
1 11 shall not apply, the amount of tuition shall be determined by
1 12 the board of directors of the community college with the
1 13 consent of the local school board, and the pupil shall not be
1 14 included in the full-time equivalent enrollment of the
1 15 community college for the purpose of computing general aid to
1 16 the community college. Tuition for nonresidents of Iowa shall
1 17 not be less than the marginal cost of instruction of a student
1 18 attending the college. A lower tuition for nonresidents may
1 19 be permitted under a reciprocal tuition agreement between a
1 20 merged area and an educational institution in another state,
1 21 if the agreement is approved by the state board. The board
1 22 may designate that a portion of the tuition moneys collected
1 23 from students be used for student aid purposes. The board
1 24 shall limit an individual student who qualifies for resident
1 25 tuition rates to a maximum of one hundred sixty semester
1 26 hours, or its equivalent in quarter hours, at the resident
1 27 rate.
1 28 Sec. 2. Section 262.9, Code 1995, is amended by adding the
1 29 following new subsection:
1 30 NEW SUBSECTION. 30. Limit an individual student who
1 31 qualifies for resident tuition rates to a maximum of one
1 32 hundred sixty semester hours at the undergraduate level at the
1 33 resident rate.
1 34 EXPLANATION
1 35 This bill limits each Iowa resident to a maximum of 160
2 1 semester hours, or its equivalent in quarter hours, at the
2 2 resident rate. The limitation applies to students of
2 3 community colleges and board of regents institutions.
