  1  1    Amend House File 428 as follows:
  1  2    #1.  By striking everything after the enacting
  1  3 clause and inserting the following:
  1  4    "Section 1.  Section 34A.2, subsection 6, paragraph
  1  5 e, subparagraph (2), Code 1995, is amended to read as
  1  6 follows:
  1  7    (2)  Recurring costs, including, but not limited
  1  8 to, network access fees and other telephone charges,
  1  9 software, equipment, and database management, and
  1 10 maintenance, including the purchase or lease of
  1 11 subscriber names, addresses, and telephone information
  1 12 from the local exchange service provider.  Recurring
  1 13 costs shall not include personnel costs for a public
  1 14 safety answering point.
  1 15    Sec. 2.  Section 34A.3, subsection 1, unnumbered
  1 16 paragraph 1, Code 1995, is amended to read as follows:
  1 17    The board of supervisors of each county shall
  1 18 establish a joint 911 service board not later than
  1 19 January 1, 1989.  Each political subdivision of the
  1 20 state having a public safety agency serving territory
  1 21 within the county is entitled to voting membership on
  1 22 the joint 911 service board.  Each private public
  1 23 safety agency operating within the area is entitled to
  1 24 nonvoting voting membership on the board.  A township
  1 25 which does not operate its own public safety agency,
  1 26 but contracts Each private safety agency under
  1 27 contract with a political subdivision within the
  1 28 county for the provision of public safety services, is
  1 29 not entitled to membership on the joint 911 service
  1 30 board, but its contractor is entitled to membership
  1 31 according to the contractor's status as a public or
  1 32 private safety agency is entitled to voting membership
  1 33 on the board.  The board of supervisors of the county
  1 34 establishing the board is also entitled to voting
  1 35 membership on the board.  The joint 911 service board
  1 36 shall develop an enhanced 911 service plan
  1 37 encompassing at minimum the entire county, unless an
  1 38 exemption is granted by the administrator permitting a
  1 39 smaller E911 service area.  The administrator may
  1 40 grant a discretionary exemption from the single county
  1 41 minimum service area requirement based upon an E911
  1 42 joint service board's or other E911 service plan
  1 43 operating authority's presentation of evidence which
  1 44 supports the requested exemption if the administrator
  1 45 finds that local conditions make adherence to the
  1 46 minimum standard unreasonable or technically
  1 47 infeasible, and that the purposes of this chapter
  1 48 would be furthered by granting an exemption.  The
  1 49 minimum size requirement is intended to prevent
  1 50 unnecessary duplication of public safety answering
  2  1 points and minimize other administrative, personnel,
  2  2 and equipment expenses.  An E911 service area must
  2  3 encompass a geographically contiguous area.  No
  2  4 exemption shall be granted from the contiguous area
  2  5 requirement.  The administrator may order the
  2  6 inclusion of a specific territory in an adjoining E911
  2  7 service plan area to avoid the creation by exclusion
  2  8 of a territory smaller than a single county not
  2  9 serviced by surrounding E911 service plan areas upon
  2 10 request of the joint 911 service board representing
  2 11 the territory.  The E911 service plan operating
  2 12 authority shall submit the plan on or before January
  2 13 1, 1994, to all of the following:"
  2 14    #2.  Title page, line 1, by inserting after the
  2 15 word "to" the following:  "E911 service systems by
  2 16 providing for additional members on joint 911 service
  2 17 boards and providing for".
