1 1 Amend Senate File 2370, as amended, passed, and
1 2 reprinted by the Senate, as follows:
1 3 #1. By striking everything after the enacting
1 4 clause and inserting the following:
1 5 "Section 1. Section 476.6, subsection 19,
1 6 paragraph d, Code 1995, is amended by striking the
1 7 paragraph and inserting in lieu thereof the following:
1 8 d. A gas or electric rate-regulated public utility
1 9 may recover, through an automatic adjustment mechanism
1 10 filed pursuant to subsection 11, over a period not to
1 11 exceed the term of the plan, the costs of an energy
1 12 efficiency plan approved by the board in a contested
1 13 case proceeding conducted pursuant to paragraph "a".
1 14 The board shall periodically conduct a contested case
1 15 proceeding to evaluate the reasonableness and prudence
1 16 of the utility's implementation of an approved energy
1 17 efficiency plan and budget. If a utility is not
1 18 taking all reasonable actions to cost-effectively
1 19 implement an approved energy efficiency plan, the
1 20 board shall not allow the utility to recover from
1 21 customers costs in excess of those costs that would be
1 22 incurred under reasonable and prudent implementation
1 23 and shall not allow the utility to recover future
1 24 costs at a level other than what the board determines
1 25 to be reasonable and prudent. If the result of a
1 26 contested case proceeding is a judgment against a
1 27 utility, that utility's future level of cost recovery
1 28 shall be reduced by the amount by which the programs
1 29 were found to be imprudently conducted. The utility
1 30 shall not represent energy efficiency in customer
1 31 billings as a separate cost or expense unless the
1 32 board otherwise approves."
