  1  1    Amend House File 2423 as follows:
  1  2    #1.  Page 1, by striking lines 12 through 23 and
  1  3 inserting the following:  "of the taxing district
  1  4 shall pass a resolution requesting the owner of record
  1  5 of the real property to conduct a joint study with the
  1  6 taxing district to determine actual costs incurred by
  1  7 the taxing district and the actual benefits received
  1  8 by the taxing district as a result of the racetrack or
  1  9 racetrack enclosure.  If the study determines the
  1 10 costs incurred by the taxing district exceed the
  1 11 benefits received, the taxing district may pass a
  1 12 resolution imposing a tax in an amount sufficient to
  1 13 recover up to the amount of the costs incurred minus
  1 14 benefits received and shall notify the county
  1 15 assessor, director of revenue and finance, and the
  1 16 owner of record of the real property by September 1
  1 17 preceding the fiscal year in which the real property
  1 18 taxes are due and payable.  Real property subject to
  1 19 tax as provided in this subsection shall continue to
  1 20 be taxed for a period of five years.  After the
  1 21 expiration of the tax, the taxing district may
  1 22 reimpose the tax for an additional five years in
  1 23 accordance with this section."
