1 1 Amend House File 2423 as follows:
1 2 #1. Page 1, by striking lines 8 through 23 and
1 3 inserting the following: "nonprofit entity, may be
1 4 subject to payment of a fee in lieu of taxes to any
1 5 taxing district in which the real property used in the
1 6 operation of the racetrack or racetrack enclosure is
1 7 located. To subject such real property to a fee in
1 8 lieu of taxes, the governing body of the taxing
1 9 district shall pass a resolution requesting the owner
1 10 of record of the real property to enter into
1 11 negotiations to establish the amount of the fee. The
1 12 fee shall not exceed the actual costs incurred by the
1 13 taxing district as a result of the racetrack or
1 14 racetrack enclosure."
1 15 #2. Title page, line 1, by striking the words
1 16 "taxation of" and inserting the following: "payment
1 17 of a fee in lieu of taxes on".
