  1  1    Amend Senate File 2022 as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  By striking everything after the enacting
  1  4 clause and inserting the following:
  1  5    "Section 1.  NEW SECTION.  455B.310A  LOCAL FEE
  1  6 AUTHORITY.
  1  7    1.  The general assembly recognizes that counties
  1  8 and cities with sanitary landfills within their
  1  9 jurisdiction are subject to a higher degree of
  1 10 environmental and other risks, as well as higher costs
  1 11 related to infrastructure demands and future
  1 12 environmental remediation.  Therefore, the general
  1 13 assembly finds it appropriate to provide local
  1 14 governments the authority to impose additional tonnage
  1 15 fees that will mitigate the environmental risks and
  1 16 additional costs local governments incur from a
  1 17 sanitary landfill within their jurisdiction.
  1 18    2.  A county may impose an additional tonnage fee
  1 19 not to exceed eleven dollars for each ton or
  1 20 equivalent volume of solid waste received and disposed
  1 21 of at a sanitary landfill located within the county.
  1 22 A city may impose an additional tonnage fee not to
  1 23 exceed three dollars and thirty-three cents for each
  1 24 ton or equivalent volume of solid waste received and
  1 25 disposed of at a sanitary landfill located within the
  1 26 city.  Revenue from the additional tonnage fee shall
  1 27 be credited to the general fund of the county or city
  1 28 collecting the additional tonnage fee and shall be
  1 29 used only for landfill abatement purposes, or costs of
  1 30 closure, postclosure care, and response actions, or
  1 31 for purposes of mitigating and compensating for the
  1 32 local risks, costs, and other adverse effects of
  1 33 sanitary landfills.  A county or city shall not impose
  1 34 an additional tonnage fee on wastes that are exempt
  1 35 from tonnage fees as provided in section 455B.310,
  1 36 subsections 3 and 7.
  1 37    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1 38 immediate importance, takes effect upon enactment."
