  1  1    Amend the amendment, H-5419, to Senate File 2443,
  1  2 as amended, passed, and reprinted by the Senate, as
  1  3 follows:
  1  4    #1.  Page 2, by striking lines 42 through 44 and
  1  5 inserting the following:
  1  6    "For deposit in the strategic investment fund for
  1  7 the purposes of the fund including providing funds for
  1  8 use in making awards from the community economic
  1  9 betterment account which, if under $500,000, must be
  1 10 to businesses able to pay 100 percent of the average
  1 11 county wage within two years of project initiation,
  1 12 and which, if $500,000 or over, must be to businesses
  1 13 able to pay at least 130 percent of the average county
  1 14 wage, for providing that the wage cap in high wage
  1 15 counties tied to an appropriate inflator for
  1 16 determining eligibility for awards, and for reporting
  1 17 on the progress made by the department in making the
  1 18 community economic betterment program a self-
  1 19 sustaining, revolving loan program, and for salaries,
  1 20 support, and not more than the following full-time
  1 21 equivalent positions:"
  1 22    #2.  Page 12, by inserting after line 45 the
  1 23 following:
  1 24    "Sec.    .  NEW SECTION.  15.113  ECONOMIC
  1 25 DEVELOPMENT ASSISTANCE – REPORT.
  1 26    In order for the general assembly to have accurate
  1 27 and complete information regarding expenditures for
  1 28 economic development and job training incentives and
  1 29 to respond to the job training needs of Iowa workers,
  1 30 the department shall report to the general assembly by
  1 31 January 15 of each year regarding all assistance or
  1 32 benefits provided under the community economic
  1 33 betterment program, the new jobs and income program,
  1 34 and the Iowa industrial new jobs training Act during
  1 35 the previous calendar year.  The report shall identify
  1 36 by company name each individual business receiving any
  1 37 assistance or benefits and shall contain a breakdown
  1 38 by company name of the amount of assistance or
  1 39 benefits provided to each individual business,
  1 40 including the amount of local and state tax
  1 41 abatements, grants, loans, on-the-job and customized
  1 42 job training moneys received, and the actual or
  1 43 estimated tax credits taken."
  1 44    #3.  Page 13, by inserting after line 8 the
  1 45 following:
  1 46    "Sec.    .  NEW SECTION.  15.328  PUBLIC RECORDS.
  1 47    Notwithstanding any other provision of the Code to
  1 48 the contrary, applications from businesses and
  1 49 communities and application files maintained by the
  1 50 department are public records.  All details of an
  2  1 award under this part shall be disclosed to the public
  2  2 at the time public notice of the award is given."
  2  3    #4.  Page 13, by inserting after line 13 the
  2  4 following:
  2  5    "Sec.    .  NEW SECTION.  15A.4  COMPETITIVE
  2  6 PROGRAMS – GOOD NEIGHBOR AGREEMENT – ADDITIONAL
  2  7 CONSIDERATION.
  2  8    For any program providing financial assistance for
  2  9 economic development in which the assistance is
  2 10 provided on a competitive basis, a business which
  2 11 enters into a good neighbor agreement shall receive
  2 12 extra consideration of at least ten points or the
  2 13 equivalent.  A good neighbor agreement is an
  2 14 enforceable contract between the business and a
  2 15 community group or coalition of community groups which
  2 16 requires the business to adhere to negotiated
  2 17 environmental, economic, labor, or other social and
  2 18 community standards.
  2 19    A business which fails to abide by the good
  2 20 neighbor agreement shall repay all financial
  2 21 assistance received under the program."
