  1  1    Amend the amendment, H-5412, to House File 2433, as
  1  2 follows:
  1  3    #1.  Page 1, by inserting after line 48 the
  1  4 following:
  1  5    "Sec.    .  Section 455D.11, subsection 5, Code
  1  6 1995, is amended to read as follows:
  1  7    5.  a.  The department shall develop criteria for
  1  8 the issuance of permits and shall issue permits to
  1  9 qualified stockpiling facilities.  The department
  1 10 shall inform the owner or operator of a waste tire
  1 11 collection site or processing site of the specific
  1 12 permit required for the waste tire collection site or
  1 13 processing site and any variance possibilities.
  1 14    b.  The department shall specify in writing to a
  1 15 person who applies for a permit or variance from the
  1 16 permit requirement of this section the department's
  1 17 reasons for denying the permit or variance.  A person
  1 18 denied a permit or variance may appeal the denial to
  1 19 the commission pursuant to chapter 17A.
  1 20    c.  The department shall process an application for
  1 21 a permit or variance in a timely manner and shall
  1 22 issue a permit or variance immediately upon
  1 23 determining that the person applying for a permit or
  1 24 variance complies with the requirements for obtaining
  1 25 the permit or variance."
  1 26    #2.  Page 6, by inserting after line 8 the
  1 27 following:
  1 28    "#   .  Title page, line 6, by inserting after the
  1 29 word "vehicles," the following:  "relating to
  1 30 obtaining a permit or variance for storing or using
  1 31 waste tires,"."
