  1  1    Amend House File 2449 as follows:
  1  2    #1.  Page 1, by inserting after line 9 the
  1  3 following:
  1  4    "Sec.    .  Section 56.2, subsection 9, Code
  1  5 Supplement 1995, is amended to read as follows:
  1  6    9.  a.  "Contribution" means any or any combination
  1  7 of the following:
  1  8    a. (1)  A gift, loan, advance, deposit, rebate,
  1  9 refund, or other transfer of money or a gift to a
  1 10 candidate's committee, political committee, state
  1 11 statutory political committee, county statutory
  1 12 political committee, or city statutory political
  1 13 committee.
  1 14    (2)  The in kind provision of goods or services
  1 15 which is intended to or actually does benefit a
  1 16 candidate's committee, political committee, state
  1 17 statutory political committee, county statutory
  1 18 political committee, or city statutory political
  1 19 committee.
  1 20    b. (3)  The payment, by any person other than a
  1 21 candidate or political committee, of compensation for
  1 22 the personal services of another person which are
  1 23 rendered to a candidate, or political committee, state
  1 24 statutory political committee, county statutory
  1 25 political committee, or city statutory political
  1 26 committee, for any such purpose.
  1 27    b.  "Contribution" shall not be construed to
  1 28 include any of the following:
  1 29    (1)  Any services provided without compensation by
  1 30 individuals volunteering their time on behalf of a
  1 31 candidate's committee, or political committee, or a
  1 32 state or county statutory political committee, except
  1 33 when organized or provided on a collective basis by a
  1 34 business, trade association, labor union, or any other
  1 35 organized group or association county statutory
  1 36 political committee, or city statutory political
  1 37 committee, provided that such time is not spent
  1 38 performing services for which, in the previous twelve
  1 39 months, the individual has been compensated as part of
  1 40 that individual's profession or other employment.
  1 41    (2)  Any goods or services provided directly by a
  1 42 state statutory political committee, county statutory
  1 43 political committee, city statutory political
  1 44 committee, or national political party, or by the paid
  1 45 staff of any such committee or party.
  1 46    (3)  "Contribution" shall not include refreshments
  1 47 Refreshments served at a campaign function so long as
  1 48 such refreshments do not exceed fifty dollars in value
  1 49 or transportation provided to a candidate so long as
  1 50 its value computed at a rate of twenty cents per mile
  2  1 does not exceed one hundred dollars in value in any
  2  2 one reporting period.
  2  3    (4)  "Contribution" shall not include something An
  2  4 item or items provided to a candidate for the
  2  5 candidate's personal consumption or use and not
  2  6 intended for or on behalf of the candidate's
  2  7 committee."
  2  8    #2.  Page 4, by inserting after line 20 the
  2  9 following:
  2 10    "8A.  For purposes of this section, all
  2 11 contributions of goods or services provided in kind
  2 12 shall be reported at the usual and customary rate of
  2 13 the contributor.  If the goods or services are
  2 14 provided for an amount less than the usual and
  2 15 customary rate of the contributor, the contribution
  2 16 amount shall be the difference between the amount
  2 17 actually paid and the usual and customary rate of the
  2 18 contributor."
  2 19    #3.  By renumbering as necessary.
