1 1 Amend House File 2407 as follows:
1 2 #1. Page 1, by inserting after line 5, the
1 3 following:
1 4 "11A. To establish policies for the distribution
1 5 of information which is stored by the general assembly
1 6 in an electronic format, including the contents of
1 7 statutes or rules, other than electronic publications
1 8 as provided in section 7A.22. The legislative council
1 9 shall establish payment rates that encourage the
1 10 distribution of such information to the public,
1 11 including private vendors reselling that information.
1 12 The legislative council shall not establish a price
1 13 that attempts to recover more than is attributable to
1 14 costs related to producing and delivering the
1 15 information."
1 16 #2. Page 1, line 6, by striking the figure:
1 17 "11A." and inserting the following: "11B."
1 18 #3. By striking page 3, line 24 through page 4,
1 19 line 30, and inserting the following:
1 20 "Sec. . Section 7A.22, subsection 3, Code 1995,
1 21 is amended by striking the subsection.
1 22 Sec. . Section 7A.22, Code 1995, is amended by
1 23 adding the following new unnumbered paragraph:
1 24 NEW UNNUMBERED PARAGRAPH. The legislative council
1 25 may establish policies for producing, editing,
1 26 distributing, and pricing electronic publications
1 27 which contain information stored by the general
1 28 assembly in an electronic format, including
1 29 information contained in publications described in
1 30 this section together with programming not originally
1 31 part of the stored information. As part of those
1 32 policies, the council may provide for electronic
1 33 publications containing specialized search and
1 34 retrieval functions, and shall ensure the widest
1 35 possible dissemination of versions of electronic
1 36 publications containing search and retrieval functions
1 37 at the lowest price practicable which shall not be
1 38 more than costs attributable to producing, editing,
1 39 and disseminating those versions."
1 40 #4. Page 6, by striking lines 8 and 9 and
1 41 inserting the following: "be more than established
1 42 pursuant to section 7A.22 for the same publication.
1 43 For the Iowa".
1 44 #5. Page 6, line 17, by inserting after the word
1 45 "ON" the following: "FREE".
1 46 #6. Page 6, by striking lines 24 through 35 and
1 47 inserting the following: "bureau. In order to
1 48 distribute these legal publications in the most
1 49 efficient manner possible to persons entitled to
1 50 receive these publications pursuant to section 18.97,
2 1 the superintendent of printing and the legislative
2 2 council may establish policies requiring payment from
2 3 such persons. The payment amount shall not be more
2 4 than established pursuant to section 7A.22 for the
2 5 same publication."
2 6 #7. Page 8, line 22, by inserting after the word
2 7 "software." the following: "A public record shall not
2 8 be withheld from the public because it is combined
2 9 with data processing software. A government body
2 10 shall not acquire any electronic data processing
2 11 system for the storage, manipulation, or retrieval of
2 12 public records that would impair the government body's
2 13 ability to permit the examination of a public record
2 14 and the copying of a public record in either written
2 15 or electronic form. If it is necessary to separate a
2 16 public record from data processing software in order
2 17 to permit the examination or copying of the public
2 18 record, the government body shall bear the cost of
2 19 separation of the public record from the data
2 20 processing software. The electronic public record
2 21 shall be made available in a format useable with
2 22 commonly available data processing or data base
2 23 management software. The cost chargeable to a person
2 24 receiving a public record separated from data
2 25 processing software under this subsection shall not be
2 26 in excess of the charge under this chapter unless the
2 27 person receiving the public record requests that the
2 28 public record be specially processed."
2 29 #8. Page 9, line 8, by striking the figure "2.42"
