1 2 #1. By striking everything after the enacting
1 3 clause and inserting the following:
1 4 "Section 1. Section 257.31, Code 1995, is amended
1 5 by adding the following new subsection:
1 6 NEW SUBSECTION. 17. The committee may grant
1 7 transportation assistance aid to a school district
1 8 from funds appropriated in this subsection for the
1 9 purpose of providing additional funds for a budget
1 10 year to school districts that have costs for mandatory
1 11 school transportation that exceed one hundred twenty-
1 12 five percent of the state average cost of mandatory
1 13 school transportation based upon the cost per pupil
1 14 transported. School districts shall annually submit
1 15 to the department of education the cost of providing
1 16 mandatory school transportation in a school year in
1 17 their transportation report filed by July 15 of the
1 18 next school year. The committee shall authorize the
1 19 payment of transportation assistance aid to a district
1 20 in an amount equal to that district's average cost of
1 21 mandatory transportation per pupil transported which
1 22 exceeds one hundred twenty-five percent of the state
1 23 average cost of mandatory transportation per pupil
1 24 transported multiplied by the number of pupils
1 25 transported mandatorily by the district. Payment for
1 26 a school year shall be made by September 1 of the
1 27 school year.
1 28 There is appropriated from the general fund of the
1 29 state to the department of education for use by the
1 30 school budget review committee, for each fiscal year,
1 31 the sum of fifteen million dollars for the payment of
1 32 transportation assistance aid to school districts
1 33 under this subsection. Transportation assistance aid
1 34 shall be miscellaneous income and shall not be
1 35 included in district cost. Unobligated and
1 36 unencumbered moneys remaining from the appropriations
1 37 made under this subsection after the September 1
1 38 payment of transportation assistance aid shall be
1 39 deposited in the assisted school districts fund
1 40 created in section 257.50.
1 41 Sec. 2. NEW SECTION. 257.50 ASSISTED SCHOOL
1 42 DISTRICTS.
1 43 1. An assisted school district is a school
1 44 district that has one or more elementary school
1 45 attendance centers in which at least fifty percent of
1 46 the students enrolled in the attendance center qualify
1 47 for free or reduced price lunches. A school district
1 48 that determines it is an assisted school district
1 49 under this section shall annually certify to the
1 50 department of education its eligibility to receive
2 1 funds under this section by October 1.
2 2 2. An assisted school districts fund is
2 3 established in the office of the treasurer of state to
2 4 be administered by the department of education.
2 5 Moneys deposited in the fund pursuant to section
2 6 257.31, subsection 17, shall be paid to school
2 7 districts pursuant to the requirements of this
2 8 section. Moneys received by eligible school districts
2 9 shall be used to limit class size, reduce student-
2 10 teacher ratios, and employ additional teacher's aides
2 11 in kindergarten through grade six in eligible
2 12 elementary school attendance centers. Moneys received
2 13 pursuant to this section shall supplement other funds
2 14 available for these purposes and shall not be used to
2 15 replace those funds. Notwithstanding section 8.33,
2 16 any balance in the fund on June 30 of any fiscal year
2 17 shall not revert to the general fund of the state.
2 18 3. The amount of moneys allocated from the
2 19 assisted school districts fund to each eligible school
2 20 district for each fiscal year shall be based upon the
2 21 proportion that the total number of pupils enrolled in
2 22 the eligible elementary school attendance centers in
2 23 the district for a budget year as defined under
2 24 section 257.6 bears to the sum of the basic
2 25 enrollments of the eligible elementary school
2 26 attendance centers in eligible school districts in the
2 27 state for that budget year.
2 28 4. Commencing with the school year beginning July
2 29 1, 1995, the department of education shall notify the
2 30 department of revenue and finance of the amount of
2 31 assisted school districts moneys to be paid to each
2 32 eligible school district. Payments shall be made by
2 33 the department of revenue and finance on a monthly
2 34 basis commencing on October 15 and ending June 15 of
2 35 each fiscal year. The payments shall be separate from
2 36 state aid payments made pursuant to sections 257.16
2 37 and 257.35. Payments made to eligible school
2 38 districts under this chapter are miscellaneous income
2 39 for purposes of chapter 257."
