PAG LIN 1 1 Amend House File 120 as follows: 1 2 #1. By striking everything after the enacting 1 3 clause and inserting the following: 1 4 "Section 1. NEW SECTION. 295.1 SCHOOL 1 5 IMPROVEMENT PROGRAM. 1 6 The general assembly finds that the fundamental 1 7 unit of educational improvement is the individual 1 8 community school. The general assembly further finds 1 9 that the success of Iowa's educational system has 1 10 resulted from the high degree of responsibility 1 11 provided to local districts with regard to educational 1 12 decisions affecting their students. The purpose of 1 13 this chapter is to provide additional resources for 1 14 improvement at the school level, to provide 1 15 compensation for school instructional staff and school 1 16 service personnel for school improvement efforts, and 1 17 to provide Iowa's students and teachers with access to 1 18 computers and computer technology in their schools. 1 19 Sec. 2. NEW SECTION. 295.2 DEFINITIONS. 1 20 1. "School level instructional staff" means an 1 21 individual holding a practitioner's license issued 1 22 under chapter 272 by the board of educational 1 23 examiners, who is employed in a nonadministrative 1 24 position by a school district pursuant to a contract 1 25 issued by a board of directors under section 279.13; 1 26 an administrator as defined in section 272.1, who is 1 27 assigned to work at one or more school sites; an 1 28 educational aide as defined under rules of the 1 29 department of education; and an area education agency 1 30 special education staff member assigned to a classroom 1 31 teaching assignment in a school district. 1 32 2. "School" means an attendance center within a 1 33 public school district under section 280.2. 1 34 3. "School service personnel" means a person 1 35 holding a practitioner's license who provides support 1 36 services to a student enrolled in school or to 1 37 practitioners employed by a school. 1 38 Sec. 3. NEW SECTION. 295.3 SCHOOL IMPROVEMENT 1 39 PLAN. 1 40 1. A school district that uses funds for purposes 1 41 described in section 295.4, subsection 3, paragraphs 1 42 "g" through "i", shall develop a plan that shall be 1 43 for a four-year period and may include plans for the 1 44 entire district and individual schools within the 1 45 district. Plans must be developed with involvement 1 46 from school level instructional staff and school 1 47 service personnel, parents, and representatives of the 1 48 school district community, and must set academic goals 1 49 for students as identified in the reports submitted 1 50 pursuant to section 280.18. School-based building 2 1 plans shall be submitted to the board of directors of 2 2 the district no later than May 1 of the preceding 2 3 school year. Plans shall indicate the additional 2 4 instructional or noninstructional duties of school- 2 5 level instructional staff and school service personnel 2 6 performed beyond the regular instructional or 2 7 noninstructional duties for compensation pursuant to 2 8 this section. 2 9 2. The board of directors shall submit, to the 2 10 department of education by June 30 of the preceding 2 11 school year, on a form provided by the department of 2 12 education, assurances that the school improvement plan 2 13 was developed pursuant to subsection 1 and that the 2 14 district will comply with subsection 3 of this 2 15 section. 2 16 3. The board of directors of each school district 2 17 and each school participating in a school improvement 2 18 plan shall report to their respective constituents on 2 19 student progress toward meeting the identified goals 2 20 for their district. The report submitted under this 2 21 subsection may be used to meet the reporting 2 22 requirements of section 280.18 if the provisions of 2 23 this subsection and section 280.18 are met. 2 24 4. Provisions of school improvement plans 2 25 involving compensation shall be consistent with 2 26 current collective bargaining agreements. 2 27 Sec. 4. NEW SECTION. 295.4 SCHOOL IMPROVEMENT 2 28 FUND. 2 29 1. A school improvement fund is created in the 2 30 office of the treasurer of state under the control of 2 31 the department of education. There is appropriated to 2 32 the school improvement fund for the fiscal year 2 33 beginning July 1, 1995, and ending June 30, 1996, the 2 34 sum of fifteen million dollars from the general fund 2 35 of the state. There is appropriated to the school 2 36 improvement fund for the fiscal year beginning July 1, 2 37 1996, and ending June 30, 1997, the sum of thirty 2 38 million dollars from the general fund of the state. 2 39 There is appropriated to the school improvement fund 2 40 for the fiscal year beginning July 1, 1997, and ending 2 41 June 30, 1998, the sum of forty-five million dollars 2 42 from the general fund of the state. There is 2 43 appropriated to the school improvement fund for the 2 44 fiscal year beginning July 1, 1998, and ending June 2 45 30, 1999, the sum of sixty million dollars from the 2 46 general fund of the state. Moneys appropriated by the 2 47 general assembly for deposit in the fund shall be paid 2 48 to the school districts, the Iowa braille and sight 2 49 saving school, and the state school for the deaf 2 50 pursuant to the requirements of this chapter. 3 1 2. Notwithstanding section 8.33, any unexpended or 3 2 unencumbered balances in the school improvement fund 3 3 at the end of each fiscal year shall be retained in 3 4 the fund until June 30, 2000. Any unexpended or 3 5 unencumbered balances of moneys received under this 3 6 chapter and remaining in the accounts established by 3 7 the districts, the Iowa braille and sight saving 3 8 school, and the state school for the deaf on June 30, 3 9 1999, shall be deposited in the school improvement 3 10 fund. For the school year beginning July 1, 1999, the 3 11 department of education shall allocate funds on a 3 12 competitive basis to the Iowa braille and sight saving 3 13 school, the state school for the deaf, and school 3 14 districts that submit to the department school 3 15 improvement plans for the purposes described in 3 16 subsection 3. The state board of education shall 3 17 adopt, by July 1, 1998, rules which establish 3 18 guidelines for the approval of plans submitted by 3 19 districts, the Iowa braille and sight saving school, 3 20 and the state school for the deaf for competitive 3 21 grants under this subsection. 3 22 3. Funds in the school improvement fund may be 3 23 used for the following purposes: 3 24 a. To purchase or lease telephone equipment, 3 25 computers, computer networks, computer programs, 3 26 computer software, computer systems, and for computer 3 27 services as defined in section 716A.1. 3 28 b. For maintaining purchases listed under this 3 29 subsection. 3 30 c. For financing for the procurement and 3 31 maintenance costs for Part III of the Iowa 3 32 communications network as provided in section 8D.13, 3 33 subsection 3. 3 34 d. The costs of establishing an electronic 3 35 classroom, or purchasing or leasing satellite 3 36 equipment, receiving equipment, studio and production 3 37 equipment, and other associated equipment. 3 38 e. The costs of purchasing or leasing audio, 3 39 visual, or audiovisual machines, machinery, or 3 40 equipment. 3 41 f. For training or staff development in the use of 3 42 equipment or software purchased or leased under this 3 43 subsection, up to ten percent of the annual allocation 3 44 may be used. 3 45 g. To provide compensation for school level 3 46 instructional staff and school service personnel for 3 47 activities and responsibilities that are part of the 3 48 school improvement plan approved by the district under 3 49 section 295.3, and are in addition to the regular 3 50 activities and duties of the school and instructional 4 1 staff and of the school service personnel; and to pay 4 2 the costs of the employer's share of federal social 4 3 security and the Iowa public employees' retirement 4 4 system, or a pension and annuity retirement system 4 5 established under chapter 294. 4 6 h. To provide for the costs of substitute 4 7 instructional staff to permit the regular 4 8 instructional staff to engage in planning or training 4 9 activities that are part of the school improvement 4 10 plan approved pursuant to section 295.3. 4 11 i. To provide for the costs associated with 4 12 specialized or generalized training that are part of 4 13 the school improvement plan approved pursuant to 4 14 section 295.3. 4 15 4. Moneys in the school improvement fund shall not 4 16 be used for technological support for school 4 17 administrators. 4 18 Sec. 5. NEW SECTION. 295.5 ALLOCATIONS AND 4 19 PAYMENTS. 4 20 1. The amount of moneys allocated from the school 4 21 improvement fund to each school district, the Iowa 4 22 braille and sight saving school, and the state school 4 23 for the deaf for each fiscal year shall be in the 4 24 proportion that the basic enrollment of a district, 4 25 the Iowa braille and sight saving school, or the state 4 26 school for the deaf for the budget year as defined 4 27 under section 257.6 bears to the sum of the basic 4 28 enrollment of the Iowa braille and sight saving 4 29 school, and the state school for the deaf, and of all 4 30 districts in the state for the budget year. The Iowa 4 31 braille and sight saving school and the state school 4 32 for the deaf shall annually certify their basic 4 33 enrollment to the department of education by October 4 34 1. 4 35 2. Commencing with the school year beginning July 4 36 1, 1995, and for each succeeding year until June 30, 4 37 1999, the department of education shall notify the 4 38 department of revenue and finance of the amount of 4 39 school improvement moneys to be paid to each school 4 40 district, the Iowa braille and sight saving school, 4 41 and the state school for the deaf. Payments shall be 4 42 made by the department of revenue and finance on a 4 43 monthly basis commencing on October 15 and ending June 4 44 15 of each fiscal year, taking into account the 4 45 relative budget position and cash position of the 4 46 state resources. The payments shall be separate from 4 47 state aid payments made pursuant to sections 257.16 4 48 and 257.35. 4 49 3. Any moneys received under this chapter, and any 4 50 interest accrued on the moneys, shall not be 5 1 commingled with state aid payments made, under 5 2 sections 257.16 and 257.35, to a school district and 5 3 shall be accounted for by the school district 5 4 separately from state aid payments. A school district 5 5 that uses funds for purposes described in section 5 6 295.4, subsection 3, paragraphs "g" through "i", shall 5 7 allocate moneys to the area education agency staff as 5 8 defined in section 295.2, subsection 1, who are 5 9 participating in the school improvement program. The 5 10 Iowa braille and sight saving school and the state 5 11 school for the deaf shall maintain a separate account 5 12 for moneys received under this chapter and any 5 13 interest accrued on the moneys. 5 14 4. Payments made to school districts under this 5 15 chapter are miscellaneous income for purposes of 5 16 chapter 257. Each district shall maintain a separate 5 17 listing within the district budget for payments 5 18 received and expenditures made pursuant to this 5 19 chapter. 5 20 5. Each school district, the Iowa braille and 5 21 sight saving school, and the state school for the deaf 5 22 shall submit annually to the department by June 30 a 5 23 detailed report accounting for the expenditure of 5 24 moneys received pursuant to this chapter. 5 25 Sec. 6. NEW SECTION. 295.6 REPEAL. 5 26 This chapter is repealed effective July 1, 2000." 5 27 #2.
