  1  1    Amend House File 2440, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 1, line 21, by inserting before the word
  1  4 "In" the following:  "1."
  1  5    #2.  Page 1, by striking lines 27 and 28 and
  1  6 inserting the following:  "dollars.
  1  7    2.  The noneconomic damage limit in subsection 1
  1  8 shall not apply to the following:
  1  9    a.  A court finding of actual malice on the part of
  1 10 the defendant.
  1 11    b.  An act or omission of a health care provider
  1 12 that does not meet the minimum standard of skill or
  1 13 care ordinarily possessed and exercised by a health
  1 14 care provider under similar circumstances."
  1 15    #3.  By renumbering as necessary.
