  1  1    Amend House File 2440, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 1, by inserting after line 28 the
  1  4 following:
  1  5    "Sec. 4.  NEW SECTION.  668B.4  CONTINGENT REPEAL.
  1  6    If the commissioner of insurance determines that
  1  7 the rate of increase in the average cost of medical
  1  8 malpractice premiums in the state from July 1, 2004,
  1  9 through June 30, 2005, exceeds the cumulative
  1 10 inflation factor for that period, this chapter is
  1 11 repealed on June 30, 2005."
