Page 4, by inserting after line 3, the 1 6 following: 1 7 "DIVISION 1 8 ACCOUNTABLE GOVERNMENT ACT 1 9 Sec. . Section 8E.103, subsection 1, Code 2003, 1 10 is amended to read as follows: 1 11 1. "Agency" means a principal central department 1 12 enumerated in section 7E.5.ForHowever, for purposes 1 13 of this chapter,eachall of the following apply: 1 14 a. The department of agriculture and land 1 15 stewardship is not considered an agency. 1 16 b. Each division within the department of commerce 1 17shall beis considered an agency, and each bureau 1 18 within a division of the department of commerceshall1 19beis considered a division, as otherwise provided in 1 20 chapter 7E." 1 21 #4. Page 4, by inserting after line 3 the 1 22 following: 1 23 "DIVISION 1 24 MILK REGULATION 1 25 Sec. . Section 192.101A, unnumbered paragraph 1 26 1, Code Supplement 2003, is amended to read as 1 27 follows: 1 28 As used in this chapter, all terms shall have the 1 29 same meaning as defined in the "Grade 'A' Pasteurized 1 30 MilkOrdinance, 2001 Revision"Ordinance" as provided 1 31 in section 192.102. However, notwithstanding the 1 32 ordinance, the following definitions shall apply: 1 33 Sec. . Section 192.102, Code Supplement 2003, 1 34 is amended to read as follows: 1 35 192.102 GRADE "A" PASTEURIZED MILK ORDINANCE. 1 36 The department shall adopt, by rule, the "Grade 'A' 1 37 Pasteurized Milk Ordinance,20012003 Revision", 1 38 including a subsequent revision of the ordinance. If 1 39 the ordinance specifies that compliance with a 1 40 provision of the ordinance's appendices is mandatory, 1 41 the department shall also adopt that provision. The 1 42 department shall not amend the ordinance, unless the 1 43 department explains each amendment and reasons for the 1 44 amendment in the Iowa administrative bulletin when the 1 45 rules are required to be published pursuant to chapter 1 46 17A. The department shall administer this chapter 1 47 consistent with the provisions of the ordinance. 1 48 Sec. . Section 192.110, subsection 1, Code 1 49 Supplement 2003, is amended to read as follows: 1 50 1. The person has a pasteurized milk and milk 2 1 products sanitation compliance rating of ninety 2 2 percent or more as calculated according to the rating 2 3 system as contained in the federal public health 2 4 service publications, "Procedures Governing the 2 5 Cooperative State-Public Health Service/Food and Drug 2 6 Administration Program for Certification of Interstate 2 7 Milk Shippers2001"2003" and "Method of Making 2 8 Sanitation Ratings of Milk Supplies,20012003 2 9 Revision". The applicable provisions of these 2 10 publications are incorporated into this section by 2 11 this reference. A copy of each publication shall be 2 12 on file with the department or in the office of the 2 13 person subject to an inspection contract as provided 2 14 in section 192.108." 2 15 #5.
