1 1 Amend House File 2460, as passed by the House, as
1 2 follows:
1 3 #1. By striking everything after the enacting
1 4 clause and inserting the following:
1 5 "Section 1. NEW SECTION. 282.9 ENROLLMENT OF
1 6 PERSON LISTED ON REGISTRY.
1 7 1. Notwithstanding sections 275.55A, 256F.4, and
1 8 282.18, or any other provision to the contrary, prior
1 9 to knowingly enrolling an individual who is required
1 10 to register as a sex offender under chapter 692A, but
1 11 who is otherwise eligible to enroll in a public
1 12 school, the board of directors of a school district
1 13 shall determine the educational placement of the
1 14 individual. Upon receipt of notice that a student who
1 15 is enrolled in the district is required to register as
1 16 a sex offender under chapter 692A, the board shall
1 17 determine the educational placement of the student.
1 18 The tentative agenda for the meeting of the board of
1 19 directors at which the board will consider such
1 20 enrollment or educational placement shall specifically
1 21 state that the board is considering the enrollment or
1 22 educational placement of an individual who is required
1 23 to register as a sex offender under chapter 692A. If
1 24 the individual is denied enrollment in a school
1 25 district under this section, the school district of
1 26 residence shall provide the individual with
1 27 educational services in an alternative setting.
1 28 2. Notwithstanding section 692A.13, or any other
1 29 provision of law to the contrary, the county sheriff
1 30 shall provide to the boards of directors of the school
1 31 districts located within the county the name of any
1 32 individual under the age of twenty-one who is required
1 33 to register as a sex offender under chapter 692A."
