PAG LIN 1 1 Section 1. Section 803.3, subsection 5, Code Supplement 1 2 2003, is amended to read as follows: 1 3 5. If a simple misdemeanor is committed in a city which is 1 4 located in two or more counties, venue shall be in the county 1 5 in which the seat of government of the city is located. 1 6 However, if the simple misdemeanor is committed in conjunction 1 7 with an offense greater than a simple misdemeanor, the trial 1 8 of the simple misdemeanor shall be in the county where the 1 9 offense was committed as provided in section 803.2. 1 10 Sec. 2. Section 805.13, subsection 1, Code Supplement 1 11 2003, is amended to read as follows: 1 12 1. Traffic violations, whether or not scheduled, and all 1 13 other scheduled violations may be tried before the nearest 1 14 magistrate in the judicial district in which the offense is 1 15 committed, or if the offense occurred in a city which is 1 16 located in two counties, the violation shall be triedin the1 17county in which the seat of government of the city is located1 18 as provided in section 803.3, subsection 5. 1 19 EXPLANATION 1 20 This bill relates to the prosecution of certain simple 1 21 misdemeanors committed in a city located in two or more 1 22 counties. 1 23 The bill makes changes to Code provisions amended by House 1 24 File 650, sections 2 and 3, from the 2003 legislative session. 1 25 The bill provides that a simple misdemeanor committed in a 1 26 city located in two or more counties shall be prosecuted in 1 27 the county where the offense occurred if the simple 1 28 misdemeanor is committed in conjunction with an offense 1 29 greater than a simple misdemeanor. 1 30 Current law provides that if a simple misdemeanor is 1 31 committed in a city located in two or more counties, the 1 32 simple misdemeanor shall be prosecuted in the county in which 1 33 the seat of government of the city is located. 1 34 LSB 5040HC 80 1 35 jm/pj/5
