  1  1    Section 1.  Section 455D.11C, subsections 2 and 3, Code
  1  2 2003, are amended by striking the subsections and inserting in
  1  3 lieu thereof the following:
  1  4    2.  Moneys in the waste tire management fund are
  1  5 appropriated and shall be used for the following purposes:
  1  6    a.  Thirty-two percent of the moneys shall be used for all
  1  7 of the following positions:
  1  8    (1)  One full-time equivalent position for the
  1  9 administration of permits and registrations for tire
  1 10 processing, storage, and hauling activities, and tire program
  1 11 initiatives.
  1 12    (2)  One and one-half full-time equivalent positions for
  1 13 waste tire-related compliance checks and inspections.  The
  1 14 full-time equivalent positions shall be divided equally
  1 15 between the field offices in the state.
  1 16    b.  Eighteen percent of the moneys shall be used for a
  1 17 public education and awareness initiative related to the
  1 18 proper tire disposal options and environmental and health
  1 19 hazards posed by improper tire storage.
  1 20    c.  Thirty percent of the moneys shall be used for market
  1 21 development initiatives for waste tires.
  1 22    d.  Fifteen percent of the moneys shall be used for waste
  1 23 tire stockpile abatement initiatives which would require a
  1 24 cost-share agreement with the landowner.
  1 25    e.  Five percent of the moneys shall be used for a study on
  1 26 the west nile virus, including where the virus is located in
  1 27 the state, how the virus might spread, where the virus might
  1 28 spread, and how the virus may be mitigated.  The moneys
  1 29 allocated under this paragraph may be carried forward to the
  1 30 fiscal years beginning July 1, 2003, and ending July 1, 2007.
  1 31    Sec. 2.  Sections 455D.11D, 455D.11E, 455D.11F, and
  1 32 455D.11H, Code 2003, are repealed.
  1 33    Sec. 3.  UNENCUMBERED OR UNOBLIGATED MONEYS –
  1 34 APPROPRIATION.  On July 1, 2004, any unencumbered or
  1 35 unobligated moneys that were awarded from the waste tire
  2  1 management fund pursuant to section 455D.11C, subsection 2,
  2  2 Code 2003, shall revert to the waste tire management fund and
  2  3 shall be reallocated and appropriated pursuant to section
  2  4 455D.11C, subsection 2, paragraph "a", as amended in this Act.  
  2  5                           EXPLANATION
  2  6    This bill appropriates moneys in the waste tire management
  2  7 fund.
  2  8    The bill changes the appropriations from the waste tire
  2  9 management fund.  The bill changes the appropriations to
  2 10 provide the following:
  2 11    1.  Of the moneys in the fund, 32 percent shall be used for
  2 12 2.50 FTEs in the department of natural resources.  One FTE
  2 13 shall be for the administration of permits and registrations
  2 14 for tire processing, storage, and hauling activities, and tire
  2 15 program initiatives.  One and one-half FTEs shall be for waste
  2 16 tire-related compliance checks and inspections at field
  2 17 offices around the state.
  2 18    2.  Of the moneys in the fund, 18 percent shall be used for
  2 19 a public education and awareness initiative related to the
  2 20 proper tire disposal options and environmental and health
  2 21 hazards posed by improper tire storage.
  2 22    3.  Of the moneys in the fund, 30 percent shall be used for
  2 23 market development initiatives for waste tires.
  2 24    4.  Of the moneys in the fund, 15 percent shall be used for
  2 25 waste tire stockpile abatement initiatives which would require
  2 26 a cost-share agreement with the landowner.
  2 27    5.  Of the moneys in the fund, 5 percent of the moneys
  2 28 shall be used for a study on west nile virus-related issues.
  2 29    The bill repeals a future repeal of the waste tire
  2 30 management fund.  The bill repeals the waste tire grant
  2 31 program and programs awarding moneys to regents institutions
  2 32 for using tire-derived fuel and end-users of processed waste
  2 33 tires.
  2 34    The bill provides that, on July 1, 2004, any unencumbered
  2 35 or unobligated moneys that were awarded from the waste tire
  3  1 management fund shall revert to the waste tire management fund
  3  2 and shall be reallocated and appropriated to fund the 2.50
  3  3 FTEs created in this bill.
