  1  1    Section 1.  Section 279.13, Code 2003, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  4.  For purposes of this section, sections
  1  4 279.14, 279.15 through 279.17, 279.19, and 279.27, unless the
  1  5 context otherwise requires, "teacher" includes the following
  1  6 individuals employed by a community college:
  1  7    a.  An instructor, but does not include an adjunct
  1  8 instructor.
  1  9    b.  A librarian, including those denoted as being a
  1 10 learning resource specialist or a media specialist.
  1 11    c.  A counselor.
  1 12    Sec. 2.  Section 279.19B, Code 2003, is amended by adding
  1 13 the following new unnumbered paragraph:
  1 14    NEW UNNUMBERED PARAGRAPH.  The licensure and coaching
  1 15 authorization requirements of this section shall not apply to
  1 16 community colleges.  An individual employed as a coach of a
  1 17 community college interscholastic athletic activity that is
  1 18 not issued a teaching contract under section 279.13 serves at
  1 19 the pleasure of the board of directors of the community
  1 20 college and is not subject to sections 279.13 through 279.19,
  1 21 and 279.27.
  1 22    Sec. 3.  Section 279.23, unnumbered paragraph 3, Code 2003,
  1 23 is amended to read as follows:
  1 24    Except as otherwise specifically provided, an
  1 25 administrator's contract shall be governed by the provisions
  1 26 of this section and sections 279.23A, 279.24, and 279.25, and
  1 27 not by section 279.13.
  1 28    PARAGRAPH DIVIDED.  For purposes of this section and
  1 29 sections 279.23A, 279.24, and 279.25, the term "administrator"
  1 30 includes school superintendents, assistant superintendents,
  1 31 educational directors employed by school districts for grades
  1 32 kindergarten through twelve, educational directors employed by
  1 33 area education agencies under chapter 273, principals,
  1 34 assistant principals, other certified school supervisors
  1 35 employed by school districts for grades kindergarten through
  2  1 twelve as defined under section 20.4, and other certified
  2  2 school supervisors employed by area education agencies under
  2  3 chapter 273.  For purposes of this section and sections
  2  4 279.23A, 279.24, and 279.25, with regard to community college
  2  5 employees, "administrator" includes the administrator of an
  2  6 instructional division or an area of instructional
  2  7 responsibility, and the administrator of an instructional
  2  8 unit, department, or section.
  2  9    Sec. 4.  2002 Iowa Acts, chapter 1047, sections 14 and 17,
  2 10 are repealed.
  2 11    Sec. 5.  2002 Iowa Acts, chapter 1047, section 20, is
  2 12 amended to read as follows:
  2 13    SEC. 20.  EFFECTIVE DATE.  Sections 1 through 4, and
  2 14 sections 6 through 13, sections 15 and 16, and section 18 of
  2 15 this Act take effect July 1, 2003.  
  2 16                           EXPLANATION
  2 17    This bill provides that Code provisions regulating
  2 18 elementary and secondary education teaching and administrator
  2 19 contracts, teacher probationary periods, evaluation criteria
  2 20 and procedures, and procedures for the discharge of teachers
  2 21 and administrators, also cover community college instructors
  2 22 other than adjunct instructors; librarians, including learning
  2 23 resource specialists and media specialists; counselors; and
  2 24 instructional administrators.
  2 25    The 2002 Session of the General Assembly enacted H.F. 2394,
  2 26 which eliminates effective July 1, 2003, licensure of
  2 27 community college faculty from the responsibilities of the
  2 28 board of educational examiners.  While a provision in the Code
  2 29 chapter governing community colleges provides the board of
  2 30 directors of a community college with the same duties and
  2 31 responsibilities provided to the board of directors of a
  2 32 school district under Code chapter 279, including those
  2 33 involving contracts with teachers and administrators, this
  2 34 bill specifies that permanent, full-time instructional
  2 35 personnel employed by a community college are subject to the
  3  1 procedures and protections of Code chapter 279.
  3  2    However, the bill exempts coaches employed by community
  3  3 colleges from the licensure and coaching authorization
  3  4 requirements of the Code.  A coach employed by, but not issued
  3  5 a teaching contract by, a community college serves at the
  3  6 pleasure of the board of directors of the community college.
  3  7    The bill strikes related provisions enacted by the 2002
  3  8 Session of the General Assembly that would otherwise take
  3  9 effect July 1, 2003.
