PAG LIN 1 1 Section 1. Section 19A.12B, Code 2003, is amended to read 1 2 as follows: 1 3 19A.12B DEFERRED COMPENSATION PLAN. 1 4 The department shall make available to eligible state 1 5 employeesby September 1, 1997,the option of utilizing mutual 1 6 funds as an investment alternative to the state's deferred 1 7 compensation plan established under section 509A.12. 1 8 Participating employees shall, to the extent permitted by law, 1 9 be allowed to transfer moneys deferred under the plan to a 1 10 mutual fund offered pursuant to section 509A.12. The 1 11 department may make the deferred compensation plan established 1 12 pursuant to this section available to governmental employees 1 13 of a public entity authorized to establish a deferred 1 14 compensation program pursuant to section 509A.12. 1 15 Sec. 2. Section 19B.5, subsection 2, Code 2003, is amended 1 16 to read as follows: 1 17 2. The department of personnel shall submit a report on 1 18 the condition of affirmative action, diversity, and 1 19 multicultural programs in state agencies covered by subsection 1 20 1 by September 30 of each year to the governor and the general 1 21 assembly.The report shall include information identifying1 22funding sources and itemized costs, including administrative1 23costs, for these programs.1 24 Sec. 3. Section 22.7, subsection 11, Code 2003, is amended 1 25 to read as follows: 1 26 11. Personal information in confidential personnel records 1 27 of public bodies including but not limited to cities, boards 1 28 of supervisors and school districts. For purposes of this 1 29 subsection, "personal information" includes, but is not 1 30 limited to, information in the personnel files of an employee 1 31 concerning investigations incident to the employee's 1 32 employment, information relating to disciplinary actions, and 1 33 complaints, grievances, and appeals. 1 34 Sec. 4. Section 70A.38, subsection 8, Code 2003, is 1 35 amended by striking the subsection. 2 1 Sec. 5. EFFECTIVE DATE. Section 4 of this Act, amending 2 2 section 70A.38, being deemed of immediate importance, takes 2 3 effect upon enactment. 2 4 EXPLANATION 2 5 This bill provides that the department of personnel can 2 6 make the state's deferred compensation program available to 2 7 other nonstate governmental employees. 2 8 The bill eliminates the requirement of the department of 2 9 personnel to include specific cost information in the annual 2 10 report the department submits on the condition of affirmative 2 11 action, diversity, and multicultural programs in state 2 12 agencies. 2 13 The bill provides that information in an employee's 2 14 personnel records concerning investigations, disciplinary 2 15 actions, complaints, grievances, and appeals is considered 2 16 personal information and a confidential record pursuant to the 2 17 state's public records law. 2 18 The bill also strikes the June 30, 2003, repeal of the 2 19 years of service incentive program. The years of service 2 20 incentive program permits state executive branch employers the 2 21 option to offer a financial incentive to an employee for 2 22 terminating state employment.
