PAG LIN 1 1 Section 1. Section 18.3, subsection 4, Code 2003, is 1 2 amended to read as follows: 1 3 4. Providing for the proper maintenance of the state 1 4 capitol, grounds, and equipment and all other state buildings 1 5 and grounds, and equipment at the seat of government, and of 1 6 the state laboratories facility in Ankeny, except those 1 7 referred to in section 216B.3, subsection 6. 1 8 Sec. 2. Section 18.8, unnumbered paragraph 1, Code 2003, 1 9 is amended to read as follows: 1 10 The director shall provide necessary lighting, fuel, and 1 11 water services for the state buildings and grounds located at 1 12 the seat of government, and for the state laboratories 1 13 facility in Ankeny, except the buildings and grounds referred 1 14 to in section 216B.3, subsection 6. 1 15 Sec. 3. Section 18.8, unnumbered paragraph 5, Code 2003, 1 16 is amended to read as follows: 1 17 Except for buildings and grounds described in section 1 18 216B.3, subsection 6; section 2.43, unnumbered paragraph 1; 1 19 and any buildings under the custody and control of the Iowa 1 20 public employees' retirement system, the director shall assign 1 21 office space at the capitol, other state buildings and 1 22 elsewhere in the city of Des Moines, and the state 1 23 laboratories facility in Ankeny, for all executive and 1 24 judicial state agencies. Assignments may be changed at any 1 25 time. The various officers to whom rooms have been so 1 26 assigned may control the same while the assignment to them is 1 27 in force. Official apartments shall be used only for the 1 28 purpose of conducting the business of the state. The term 1 29 "capitol" or "capitol building" as used in the Code shall be 1 30 descriptive of all buildings upon the capitol grounds. The 1 31 capitol building itself is reserved for the operations of the 1 32 general assembly, the governor and the courts and the 1 33 assignment and use of physical facilities for the general 1 34 assembly shall be pursuant to section 2.43. 1 35 Sec. 4. Section 18.10, Code 2003, is amended to read as 2 1 follows: 2 2 18.10CAPITOLBUILDINGS AND GROUNDS RULES. 2 3 The director shall establish, publish, and enforce rules 2 4 regulating and restricting the use by the public of the 2 5 capitol buildings and grounds and of the state laboratories 2 6 facility in Ankeny. The rules when established shall be 2 7 posted in conspicuous places about the capitol buildings and 2 8 grounds and the state laboratories facility, as applicable. 2 9 Any person violating any rule, except a parking regulation, 2 10 shall be guilty of a simple misdemeanor. 2 11 Sec. 5. Section 18.11, Code 2003, is amended to read as 2 12 follows: 2 13 18.11 PARKING REGULATIONS. 2 14 The director shall establish, publish, and enforce rules 2 15 regulating, restricting, or prohibiting the use by state 2 16 officials, state employees, and the public, of motor vehicle 2 17 parking facilities at the state capitol complex and at the 2 18 state laboratories facility in Ankeny. The assignment of 2 19 legislative parking spaces shall be under the control of the 2 20 legislative council. The rules established by the director 2 21 may establish fines for violations and a procedure for payment 2 22 of the fines. The director may order payment of a fine and 2 23 enforce the order in the district court. 2 24 Motor vehicles parked in violation of the rules may be 2 25 removed without the owner's or operator's consent and at the 2 26 owner's or operator's expense. Motor vehicles removed and not 2 27 claimed within thirty days of their removal or vehicles 2 28 abandoned within the capitol grounds, may be disposed of in 2 29 accordance with the provisions of sections 321.85 through 2 30 321.91. 2 31 The parking rules established shall be posted in 2 32 conspicuous places at the capitol complex and at the state 2 33 laboratories facility in Ankeny, as applicable. Copies of the 2 34 rules shall be made available to all state officials and 2 35 employees and any other person who requests a copy of the 3 1 rules. 3 2 All fines collected by the department shall be forwarded to 3 3 the treasurer of state and deposited in the general fund. 3 4 Sec. 6. Section 18.12, subsection 2, Code 2003, is amended 3 5 to read as follows: 3 6 2. Have at all times, charge of and supervision over the 3 7janitorscustodians, and other employees of the department in 3 8 and about the capitol and other state buildings, and the state 3 9 laboratories facility in Ankeny, except the buildings and 3 10 grounds referred to in section 216B.3, subsection 6, at the 3 11 seat of government. 3 12 Sec. 7. Section 18.12, subsection 4, Code 2003, is amended 3 13 to read as follows: 3 14 4. Keep in the director's office a complete record 3 15 containing an itemized account of all state property, 3 16 including furniture and equipment, under the director's care 3 17 and control, and plans and surveys of the public grounds, 3 18 buildings, and underground constructions at the seat of 3 19 government and of the state laboratories facility in Ankeny. 3 20 Sec. 8. Section 18.12, subsection 7, Code 2003, is amended 3 21 to read as follows: 3 22 7. Contract, with the approval of the executive council, 3 23 for the repair, remodeling or, if the condition warrants, 3 24 demolition of all buildings and grounds of the state at the 3 25 seat of government, at the state laboratories facility in 3 26 Ankeny, and the institutions of the department of human 3 27 services and the department of corrections for which no 3 28 specific appropriation has been made, if the cost of repair, 3 29 remodeling, or demolition will not exceed one hundred thousand 3 30 dollars when completed. The cost of repair projects for which 3 31 no specific appropriation has been made shall be paid from the 3 32 fund provided in section 7D.29. 3 33 EXPLANATION 3 34 This bill provides that the department of general services 3 35 is responsible for the operation, maintenance, assignment of 4 1 space, and other facility management activities as it relates 4 2 to the state laboratories facility in Ankeny. Specifically, 4 3 the bill provides that the department is responsible for 4 4 providing necessary utility services to the facility, 4 5 assigning office space, establishing rules governing public 4 6 access to the facility, assigning parking at the facility, 4 7 providing custodial services, and contracting for the repair, 4 8 remodeling, or demolition of buildings at the facility. 4 9 LSB 1259DP 80 4 10 ec/pj/5.1
