  1  4 RELATING TO THE ESTABLISHMENT OF DRAINAGE AND LEVEE DISTRICTS, 
  1  5    AND PROVIDING AN EFFECTIVE DATE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 468.315, Code 2003, is amended to read
  1 10 as follows:
  1 11    468.315  AUTHORITY TO INCLUDE CITY.
  1 12    The A county board of any county shall have supervisors has
  1 13 the same power to establish a drainage or levee district that
  1 14 includes the whole or any part of any a city as they have the
  1 15 county board does to establish districts a district located
  1 16 wholly outside of such cities a city, including providing for
  1 17 the assessment of damages and benefits within such cities, but
  1 18 no a city.  However, a county board of supervisors shall have
  1 19 power or authority to establish not do any of the following:
  1 20    1.  Establish a drainage or levee district which lies
  1 21 located wholly within the corporate limits of any a city, nor
  1 22 in any case to establish any unless the city consents by
  1 23 resolution adopted by its city council.
  1 24    2.  Establish a district for sanitary sewer purposes.
  1 25    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1 26 immediate importance, takes effect upon enactment.
