1 1 Section 1. Section 331.438, subsection 2, paragraph c,
1 2 Code 2003, is amended to read as follows:
1 3 c. The department of human services shall provide for
1 4 payment of the amount due a county for the county's allowed
1 5 growth factor adjustment determined in accordance with this
1 6 subsection. However, if the state has outstanding billings to
1 7 a county for mental health, mental retardation, or
1 8 developmental disabilities services, the department has
1 9 followed the procedures in the department's administrative
1 10 rules for offset of county debts owed to the department, the
1 11 billings have been outstanding for one year or more, and the
1 12 county did not contest the billing during the one-year period,
1 13 the county's allowed growth factor adjustment payment shall be
1 14 reduced by the amount of the outstanding billings that is
1 15 attributable to mental health, mental retardation, and
1 16 developmental disabilities services. The amount of the
1 17 reduction of the county's allowed growth factor adjustment
1 18 payment shall be considered a repayment receipt and shall be
1 19 credited as though remitted by the county. The director of
1 20 human services shall authorize warrants payable to the county
1 21 treasurer for the amounts due and the warrants shall be mailed
1 22 in January of each year. The county treasurer shall credit
1 23 the amount of the warrant to the county's services fund
1 24 created under section 331.424A.
1 25 Sec. 2. APPLICABILITY. The requirements of section
1 26 331.438, subsection 2, paragraph "c", as amended by this Act,
1 27 are not applicable to a billing described in 2001 Iowa Acts,
1 28 chapter 155, section 12.
