  1  1    Section 1.  NEW SECTION.  80B.11D  TRAINING OF INDIVIDUALS
  1  2 WHO ARE NOT LAW ENFORCEMENT OFFICERS.
  1  3    1.  The director of the academy, subject to the approval of
  1  4 the council, shall adopt rules pursuant to this section and
  1  5 chapter 17A, that provide for the acceptance of an application
  1  6 for attendance at an approved law enforcement training school
  1  7 from an individual who, at the time of submitting the
  1  8 application for attendance, is not a law enforcement officer,
  1  9 but who intends to become certified as a law enforcement
  1 10 officer.  An individual who submits an application pursuant to
  1 11 this section shall, at a minimum, submit proof of successful
  1 12 completion of a two-year or four-year police science or
  1 13 criminal justice program accredited by the academy at an
  1 14 accredited educational institution.
  1 15    2.  Notwithstanding subsection 1, an individual shall not
  1 16 be accepted at an approved law enforcement training school
  1 17 pursuant to subsection 1 if such acceptance would result in
  1 18 the nonacceptance of another qualifying applicant who is a law
  1 19 enforcement officer.
  1 20    3.  This section shall apply only to individuals who apply
  1 21 for certification through a short course of study as
  1 22 established by rule.
  1 23    4.  a.  A law enforcement agency may sponsor an individual
  1 24 who intends to become certified as a law enforcement officer
  1 25 at an approved law enforcement training school that conducts
  1 26 training on or after January 1, 2003, if all of the following
  1 27 conditions are met:
  1 28    (1)  The individual submits proof of successful completion
  1 29 of all requisite approved law enforcement training courses,
  1 30 from colleges in this state offering a two-year or four-year
  1 31 degree program and meeting the standards of the law
  1 32 enforcement academy.
  1 33    (2)  The individual submits a letter of intent to accept
  1 34 employment with the sponsoring law enforcement agency or is
  1 35 hired by a law enforcement agency and is certified after
  2  1 completion of the training program within a twelve-month
  2  2 period.
  2  3    b.  An individual who meets the requirements of paragraph
  2  4 "a" shall apply through the Iowa law enforcement academy for
  2  5 acceptance into the program and also be required to attend the
  2  6 academy for testing and certification purposes relating to the
  2  7 required standards.  
  2  8                           EXPLANATION
  2  9    This bill relates to the training of an individual who is
  2 10 not a law enforcement officer but who intends to become a law
  2 11 enforcement officer.
  2 12    The bill requires the director of the law enforcement
  2 13 academy, subject to the approval of the law enforcement
  2 14 academy council, to adopt administrative rules that provide
  2 15 for the acceptance of an application for attendance at an
  2 16 approved law enforcement training school from an individual
  2 17 who is not a law enforcement officer but who intends to become
  2 18 a law enforcement officer.  The bill provides that an
  2 19 individual who submits an application shall submit proof of
  2 20 successful completion of either a two-year or four-year police
  2 21 science or criminal justice program at an accredited
  2 22 educational institution.
  2 23    The bill only applies to individuals who apply for
  2 24 certification through a short course of study as established
  2 25 by administrative rule of the director.
  2 26    The bill further provides that a law enforcement agency may
  2 27 sponsor an individual who intends to become certified as a law
  2 28 enforcement officer that conducts training on or after January
  2 29 1, 2003, the individual submits proof of successful completion
  2 30 of all requisite approved law enforcement training courses and
  2 31 the individual submits a letter of intent to accept employment
  2 32 with the sponsoring law enforcement agency or is hired by a
  2 33 law enforcement agency and is certified after completion of
  2 34 the training program within a 12-month period.  In addition,
  2 35 such individual shall receive all testing and subsequent
  3  1 certification through the Iowa law enforcement academy.
