PAG LIN 1 1 HOUSE FILE 541 1 2 1 3 AN ACT 1 4 RELATING TO THE FEE AND USE OF FEE FOR A CERTIFICATE OF BIRTH. 1 5 1 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 7 1 8 Section 1. Section 144.13A, Code 2003, is amended to read 1 9 as follows: 1 10 144.13A FEES USE OF FUNDS. 1 11 1. The state registrar shall charge the parent aten1 12dollarfee for the registration of a certificate of birthand1 13aas follows: 1 14 a. Beginning July 1, 2003, and ending June 30, 2005, a fee 1 15 of fifteen dollars. 1 16 b. Beginning July 1, 2005, a fee of twenty dollars. 1 17 2. The state registrar shall charge the parent a separate 1 18 fee established under section 144.46 for a certified copy of 1 19 the certificate. The certified copy shall be mailed to the 1 20 parent by the state registrar. 1 21 3. If the person responsible for the filing of the 1 22 certificate of birth under section 144.13 is not the parent, 1 23 the person is entitled to collect the fee from the parent. 1 24 The fee shall be remitted to the state registrar. If the 1 25 expenses of the birth are reimbursed under the medical 1 26 assistance program established by chapter 249A, or paid for 1 27 under the statewide indigent patient care program established 1 28 by chapter 255, or paid for under the obstetrical and newborn 1 29 indigent patient care program established by chapter 255A, or 1 30 if the parent is indigent and unable to pay the expenses of 1 31 the birth and no other means of payment is available to the 1 32 parent, the registration fee and certified copy fee are 1 33 waived. If the person responsible for the filing of the 1 34 certificate is not the parent, the person is discharged from 1 35 the duty to collect and remit the fee under this section if 2 1 the person has made a good faith effort to collect the fee 2 2 from the parent. 2 3 4. The fees collected by the state registrar shall be 2 4 remitted to the treasurer of state for deposit in the general 2 5 fund of the state. 2 6 a. It is the intent of the general assembly that the funds 2 7 generated from the registration fees be appropriated and used 2 8 as follows: 2 9 (1) Beginning July 1, 2003, and ending June 30, 2005, ten 2 10 dollars of each fee for primary and secondary child abuse 2 11 prevention programs, and five dollars of each fee for the 2 12 birth defects institute central registry established pursuant 2 13 to section 136A.6. 2 14 (2) Beginning July 1, 2005, ten dollars of each fee for 2 15 primary and secondary child abuse prevention programs, and ten 2 16 dollars of each fee for the birth defects institute central 2 17 registry established pursuant to section 136A.6. 2 18 b. It is the intent of the general assembly that the funds 2 19 generated from the fees as established under section 144.46 2 20 for the mailing of the certified copy of the birth certificate 2 21 be appropriated and used to support the distribution of the 2 22 automatic birth certificate and the implementation of the 2 23 electronic birth certificate system. 2 24 2 25 2 26 2 27 CHRISTOPHER C.
