  1  4 RELATING TO THE USE OF SICK LEAVE BY CERTAIN MEMBERS OF THE
  1  5    IOWA DEPARTMENT OF PUBLIC SAFETY PEACE OFFICERS' RETIREMENT,
  1  6    ACCIDENT, AND DISABILITY SYSTEM WHO ARE TEMPORARILY
  1  7    INCAPACITATED FOR DUTY AND PROVIDING AN EFFECTIVE DATE.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 10 
  1 11    Section 1.  Section 97A.6, subsection 5, paragraph b, Code
  1 12 2003, is amended to read as follows:
  1 13    b.  Should a member in service become incapacitated for
  1 14 duty as a natural and proximate result of an injury, disease,
  1 15 or exposure incurred or aggravated while in the actual
  1 16 performance of duty at some definite time or place, the member
  1 17 shall, upon being found to be temporarily incapacitated
  1 18 following an examination by the board of trustees, be entitled
  1 19 to receive the member's fixed pay and allowances, without
  1 20 using the member's sick leave, until re-examined reexamined by
  1 21 the board and found to be fully recovered or permanently
  1 22 disabled.  In addition, a member found to be temporarily
  1 23 incapacitated under this paragraph shall be credited with any
  1 24 sick leave used prior to the determination that the member was
  1 25 temporarily incapacitated under this paragraph for the period
  1 26 of time sick leave was used.
  1 27    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1 28 immediate importance, takes effect upon enactment.
