PAG LIN 1 1 HOUSE FILE 341 1 2 1 3 AN ACT 1 4 RELATING TO PERSONNEL AND INSTRUCTORS EMPLOYED BY 1 5 COMMUNITY COLLEGES. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 279.13, Code 2003, is amended by adding 1 10 the following new subsection: 1 11 NEW SUBSECTION. 4. For purposes of this section, sections 1 12 279.14, 279.15 through 279.17, 279.19, and 279.27, unless the 1 13 context otherwise requires, "teacher" includes the following 1 14 individuals employed by a community college: 1 15 a. An instructor, but does not include an adjunct 1 16 instructor. 1 17 b. A librarian, including those denoted as being a 1 18 learning resource specialist or a media specialist. 1 19 c. A counselor. 1 20 Sec. 2. Section 279.19B, Code 2003, is amended by adding 1 21 the following new unnumbered paragraph: 1 22 NEW UNNUMBERED PARAGRAPH. The licensure and coaching 1 23 authorization requirements of this section shall not apply to 1 24 community colleges. An individual employed as a coach of a 1 25 community college interscholastic athletic activity who is not 1 26 issued a teaching contract under section 279.13 serves at the 1 27 pleasure of the board of directors of the community college 1 28 and is not subject to sections 279.13 through 279.19, and 1 29 279.27. 1 30 Sec. 3. Section 279.23, unnumbered paragraph 3, Code 2003, 1 31 is amended to read as follows: 1 32 Except as otherwise specifically provided, an 1 33 administrator's contract shall be governed by the provisions 1 34 of this section and sections 279.23A, 279.24, and 279.25, and 1 35 not by section 279.13. 2 1 PARAGRAPH DIVIDED. For purposes of this section and 2 2 sections 279.23A, 279.24, and 279.25, the term "administrator" 2 3 includes school superintendents, assistant superintendents, 2 4 educational directors employed by school districts for grades 2 5 kindergarten through twelve, educational directors employed by 2 6 area education agencies under chapter 273, principals, 2 7 assistant principals, other certified school supervisors 2 8 employed by school districts for grades kindergarten through 2 9 twelve as defined under section 20.4, and other certified 2 10 school supervisors employed by area education agencies under 2 11 chapter 273. For purposes of this section and sections 2 12 279.23A, 279.24, and 279.25, with regard to community college 2 13 employees, "administrator" includes the administrator of an 2 14 instructional division or an area of instructional 2 15 responsibility, and the administrator of an instructional 2 16 unit, department, or section. 2 17 Sec. 4. 2002 Iowa Acts, chapter 1047, sections 14 and 17, 2 18 are repealed. 2 19 Sec. 5. 2002 Iowa Acts, chapter 1047, section 20, is 2 20 amended to read as follows: 2 21 SEC. 20. EFFECTIVE DATE. Sections 1 through 4,and2 22 sections 6 through 13, sections 15 and 16, and section 18 of 2 23 this Act take effect July 1, 2003. 2 24 2 25 2 26 2 27 CHRISTOPHER C.
