1 1 Section 1. Section 714.16, subsection 2, Code 2003, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. o. It is an unlawful practice for an air
1 4 common carrier providing passenger service to or from this
1 5 state to refuse to refund the cost of a ticket purchased in
1 6 this state by a consumer for departure on such air common
1 7 carrier from a location in this state if the consumer is
1 8 unable to use the ticket as a result of an illness which, as
1 9 confirmed by a licensed physician, prevents the consumer from
1 10 traveling at the time designated on the ticket.
1 11 For purposes of this paragraph, "air common carrier" means
1 12 a person engaged in transporting passengers for hire in
1 13 interstate or foreign commerce by aircraft and operating
1 14 regularly scheduled flights under a certificate of public
1 15 convenience issued by the United States civil aeronautics
1 16 board.
1 17 EXPLANATION
1 18 This bill provides that it is an unlawful practice under
1 19 the Iowa consumer fraud law for an air common carrier
1 20 providing passenger service to or from this state to refuse to
1 21 refund the cost of a ticket purchased by a consumer if the
1 22 consumer is unable to use the ticket as a result of an illness
1 23 which, as confirmed by a licensed physician, prevents the
1 24 consumer from traveling at the time designated on the ticket.
1 25 A person committing an unlawful practice is subject to a
1 26 temporary restraining order, preliminary injunction, or
1 27 permanent injunction prohibiting the person from continuing
1 28 the practice. The court may also impose civil penalties.
