PAG LIN 1 1 Section 1. NEW SECTION. 28M.1 CHILDREN'S MENTAL HEALTH 1 2 INITIATIVE. 1 3 1. The directors of human services and public health, the 1 4 attorney general, and the director of the department of 1 5 education shall jointly create and provide staffing for a 1 6 children's mental health planning group in accordance with 1 7 this section. All of the following shall be represented on 1 8 the planning group: 1 9 a. Each of the three departments and the juvenile law 1 10 section of the office of the attorney general. 1 11 b. Area education agencies. 1 12 c. The division of criminal and juvenile justice planning 1 13 of the department of human rights. 1 14 d. School counselors, special education program 1 15 representatives, and other representatives of local school 1 16 districts. 1 17 e. County mental health, mental retardation, and 1 18 developmental disabilities services single entry point process 1 19 administrators. 1 20 f. County medical assistance targeted case management 1 21 service providers. 1 22 g. Community mental health centers. 1 23 h. Community empowerment area board designees. 1 24 i. Public and private children's mental health services 1 25 providers and providers of funding for the services. 1 26 j. Mental health and developmental disabilities commission 1 27 designees. 1 28 k. Family members and others proposed by interested 1 29 persons and jointly appointed by the state agency heads 1 30 creating the planning group. 1 31 2. The planning group shall develop proposals to assist 1 32 communities in developing a collaborative initiative to 1 33 improve the availability of mental health services to children 1 34 using schools as a focal point, by taking a proactive approach 1 35 to preventing children's problems from becoming more serious 2 1 and ensuring that the services may be easily accessed. The 2 2 planning group shall consider the following options in 2 3 developing proposals: 2 4 a. Using the child welfare and juvenile justice funding 2 5 decategorization projects operated under section 232.188 or 2 6 community empowerment area boards under chapter 28 to employ a 2 7 person within schools to provide case management and resource 2 8 and referral for children's mental health services. The 2 9 person would develop a system of coordination or contracting 2 10 between service providers, community mental health centers, 2 11 and schools. 2 12 b. Coordinating with local mental health service providers 2 13 to base a mental health professional within local school 2 14 districts to provide services to children which may include 2 15 case management, referral, and individual and family therapy. 2 16 c. Assembling key stakeholders to assist schools in 2 17 developing collaborative efforts between various service 2 18 providers to make children's mental health services available 2 19 through schools, which may include any of the following: in- 2 20 home family therapy, facility-based programming, and in-school 2 21 therapy or assessments. 2 22 3. In addition to the proposals developed in accordance 2 23 with subsection 2, the planning group shall consider other 2 24 approaches which may be implemented at the state or local 2 25 level for improving children's mental health services and 2 26 shall identify any potential funding sources for the proposals 2 27 and approaches. The planning group shall report any findings 2 28 and recommendations to the governor and the general assembly. 2 29 The initial report shall be submitted on or before December 2 30 19, 2003, and additional reports shall be submitted at least 2 31 annually by that date until the planning group submits a final 2 32 report. Notice of submission of the final report shall also 2 33 be provided to the Code editor. 2 34 EXPLANATION 2 35 This bill requires the directors of human services and 3 1 public health, the attorney general, and the director of the 3 2 department of education to jointly create and provide staffing 3 3 for a children's mental health planning group to include 3 4 various entities that are currently involved with child and 3 5 adult mental health services. 3 6 The planning group is to develop proposals to assist 3 7 communities in developing a collaborative initiative to 3 8 improve the availability of mental health services for 3 9 children using schools as a focal point, by taking a proactive 3 10 approach to preventing children's problems from becoming more 3 11 serious, and ensuring that the services may be easily 3 12 accessed. The bill outlines options for the planning group to 3 13 consider. 3 14 In addition to the proposals, the planning group is 3 15 directed to consider other approaches which may be implemented 3 16 at the state or local level for improving children's mental 3 17 health services and to identify potential funding sources. 3 18 The planning group is required to report its findings and 3 19 recommendations to the governor and general assembly. The 3 20 initial report is required to be submitted by December 19, 3 21 2003, and reports are to be submitted annually thereafter 3 22 until the final report is submitted.
