  1  1    Amend the Senate amendment, H-8608, to House File
  1  2 2577, as amended, passed, and reprinted by the House,
  1  3 as follows:
  1  4    1.  Page 1, by inserting after line 2, the
  1  5 following:
  1  6    "#   .  Page 8, by inserting after line 9, the
  1  7 following:
  1  8    "Sec.    .  Section 142A.3, subsection 2, Code
  1  9 2003, is amended to read as follows:
  1 10    2.  A commission on tobacco use prevention and
  1 11 control is established to develop policy, provide
  1 12 direction for the initiative, and perform all other
  1 13 duties related to the initiative and other tobacco use
  1 14 prevention and control activities as directed by this
  1 15 chapter or referred to the commission by the director
  1 16 of public health.
  1 17    Sec.    .  Section 142A.4, Code 2003, is amended by
  1 18 adding the following new subsection:
  1 19    NEW SUBSECTION.  12A.  Represented by the
  1 20 chairperson of the commission, annually appear before
  1 21 the joint appropriations subcommittee that makes
  1 22 recommendations concerning the commission's budget to
  1 23 report on budget expenditures and division operations
  1 24 relative to the prior fiscal year and the current
  1 25 fiscal year.
  1 26    Sec.    .  Section 142A.5, subsection 1, paragraph
  1 27 b, Code Supplement 2003, is amended to read as
  1 28 follows:
  1 29    b.  Employ a separate division administrator who,
  1 30 in accordance with the requirements of section 142A.4,
  1 31 subsection 14, in a full-time equivalent position
  1 32 whose sole responsibility and duty shall be
  1 33 responsible for the administration and oversight of
  1 34 the division.  The division administrator shall report
  1 35 to and shall serve at the pleasure of the director.
  1 36 The administrator shall be exempt from the merit
  1 37 system provisions of chapter 8A, subchapter IV.
  1 38    Sec.    .  Section 142A.5, subsection 2, Code
  1 39 Supplement 2003, is amended by adding the following
  1 40 new paragraph:
  1 41    NEW PARAGRAPH.  g.  Provide necessary information
  1 42 to the commission to assist the commission in making
  1 43 its annual report to the joint appropriations
  1 44 subcommittee pursuant to section 142A.4, subsection
  1 45 12A, and in fulfilling other commission duties
  1 46 pursuant to section 142A.4.""
  1 47    #2.  By striking page 1, line 45, through page 2,
  1 48 line 6.
  1 49    #3. By renumbering as necessary.
