1 3 #1. Page 8, by inserting after line 32, the
1 4 following:
1 5 "Sec. . Section 234.39, subsection 6, if
1 6 enacted by 2004 Iowa Acts, Senate File 2298, is
1 7 amended by striking the subsection.
1 8 Sec. . Section 272C.3, subsection 1, paragraph
1 9 k, Code Supplement 2003, is amended to read as
1 10 follows:
1 11 k. Establish a licensee review committee for the
1 12 purpose of evaluating and monitoring licensees who are
1 13 impaired as a result of alcohol or drug abuse,
1 14 dependency, or addiction, or by any mental or physical
1 15 disorder or disability, and who self-report the
1 16 impairment to the committee, or who are referred by
1 17 the board to the committee. Members of the committee
1 18 shall receive actual expenses for the performance of
1 19 their duties and shall be eligible to receive per diem
1 20 compensation pursuant to section 7E.6. The board
1 21 shall adopt rules for the establishment and
1 22 administration of the committee, including but not
1 23 limited to establishment of the criteria for
1 24 eligibility for referral to the committee and the
1 25 grounds for disciplinary action for noncompliance with
1 26 committee decisions. Information in the possession of
1 27 the board or the licensee review committee, under this
1 28 paragraph, shall be subject to the confidentiality
1 29 requirements of section 272C.6. Referral of a
1 30 licensee by the board to a licensee review committee
1 31 shall not relieve the board of any duties of the board
1 32 and shall not divest the board of any authority or
1 33 jurisdiction otherwise provided. A licensee who
1 34 violates section 272C.10 or the rules of the board
1 35 while under review by the licensee review committee
1 36 shall be referred to the board for appropriate
1 37 action."
1 38 #2. Page 9, by inserting after line 18, the
1 39 following:
1 40 "(1A) The Iowa department of public health shall
1 41 negotiate a sole source contract with a nonprofit
1 42 corporation that mentors through live music and
1 43 receives funds through private partnership to
1 44 implement this paragraph "b"."
1 45 #3. Page 9, by inserting after line 26, the
1 46 following:
1 47 "Sec. . TOBACCO USE PREVENTION AND CONTROL
1 48 BUREAU CHIEF. Notwithstanding any provision directing
1 49 the director of public health to employ a division
1 50 administrator for the division of tobacco use
2 1 prevention and control, if enacted by 2004 Iowa Acts,
2 2 Senate File 2298, the director of public health shall
2 3 employ a bureau chief for the division of tobacco use
2 4 prevention and control in a full-time-equivalent
2 5 position with a salary commensurate with the full-
2 6 time-equivalent position."
2 7 #4. By renumbering, relettering, or redesignating
2 8 and correcting internal references as necessary.
